المستخلص: موضوع البحث: أثر غيبة الزوج عن زوجته في فسخ عقد النكاح: دراسة فقهية مقارنة. أهداف البحث: يهدف البحث إلى بيان حكم طلب الزوجة فسخ عقد النكاح في حال غيبة الزوج عنها، سواء كانت غيبته منقطعة لا يعلم فيها حياته من مماته، أم غير منقطعة لم تنقطع فيها أخباره. منهج البحث: المنهج الاستقرائي، التحليل، الاستنباطي. أهم النتائج: أولا: أن الراجح في حكم فسخ عقد النكاح حال غيبة الزوج غيبة منقطعة ما يلي: 1-إذا كان ظاهر غيبة الزوج الهلاك، فإنه يحق لزوجته المطالبة بفسخ عقد النكاح. 2-إذا كان ظاهر غيبته السلامة، فإنه لا يحق لها ذلك. ثانيا: أن الراجح في حكم فسخ عقد النكاح حال غيبة الزوج غيبة غير منقطعة ما يلي: 1-يجوز للمرأة المطالبة بفسخه في حال عدم العذر. 2-لا يحق للمرأة المطالبة بفسخه في حال العذر. التوصيات: دراسة المسائل المعاصرة المتعلقة بموضوع البحث.

The Goals of the research: The research aims to explain the Islamic attitude of requesting the divorce (Dissolution of the marriage contract) by the wife in case of the absence of her husband, including whether his absence is continuous or discontinuous. Research Methodology: In this research, I followed the inductive, analytical, and deductive methods through the following steps: 1. Determining the disagreement points in every topic. 2. Mentioning the scholars’ opinions and their evidences in the topics, discussing their views, and concluding the strongest opinion. 3. Referring Quranic verses to their chapters and assigning the prophetic texts to their sources. 4. Referring the juristic (Fiqh) opinions to their sources. The Main Results: First: The strongest opinion (From the point of view of the researcher) in case of the discontinuous absence of the husband: 1. If the strongest possibility is the death of the husband, the wife is entitled to claim the dissolution of marriage. 2. If the strongest probability is survival of the husband, the wife is NOT entitled to claim the dissolution of marriage. Second: The strongest opinion (From the point of view of the researcher) in case of the continuous absence of the husband: 1. The wife may demand the dissolution of marriage in case of the unexcused absence of the husband. 2. The wife may NOT demand the dissolution of marriage in case of the excused absence of the husband. Research Recommendations: The researcher recommends researching the contemporary issues related to the research topic.
