المستخلص: الطمأنينة و الاستقرار والسكن النفسي هدف يسمو إليه عقد الزواج، علاوة على هدف تأسيس اللبنة الأولى في المجتمع؛ بما فيها الأسرة وتنشئة الأولاد.
وبغيبة الزوج و فقده، يتأثر استقرار الحياة الزوجية، وقد يتلاشى، إذ الفراق ألم معنوي؛ قد يهون أمامه ترك القيام بكثير من الواجبات الزوجية فحسب.
وقد يتسنى للحياة الزوجية الاستمرار وتحقق أهدافها ومقاصدها حالة ابتعاد الزوجين، إذ يمكن للزوجة السكوت عن غيبة زوجها إن غاب غيبة قصيرة صاحبها عذر؛ مما لا يؤثر على الزوجة و لا يضر بها، لأن مبنى الحياة الزوجية الاستقرار مما يتنافى مع إثبات الخيار بالفسخ لكل حادث طارئ.
أما غيبته الطويلة دون عذر مقبول فأمر مخالف، لما فيه من تحقق الإضرار بالزوجة، و لما يعش كلاهما شيئا من الحياة الزوجية و معانيها مما يرجح الخيار بالفسخ.
وسلامة الاستقرار النفسي عموما لا يتعارض مع تتبع واشتراط إجراءات السلامة في تقديم موجباته بترجيح الخيار بالفسخ عن طريق إجراءات التقاضي.
لذا فقد درس البحث معنى الغيبة وشروط التفريق بها علاوة على آراء الفقهاء في مشروعية الفسخ القضائي للغيبة وختاما دور القاضي وسلطته في سير الدعوى وإثباتها والحكم عليها.

Tranquility, stability and psychological calmness is a goal of the marriage, as well as the goal of establishing the first brick in the society, including the family and the upbringing of children. In the absence of the husband and his death, the stability of marital life is affected, and may fade, as separation is a moral pain; which may make easier before him to leave many of the marital duties. It may be possible for marital life to continue and achieve its objectives and purposes, in the situation of alienation of spouses, as the wife can remain silent about the absence of her husband if the absence is for a short period because of an excuse; which does not affect the wife and does not harm her, because stability is the basis of marital life which is incompatible with the option of dissolution of the marriage in any emergency incident. As for his long absence without an acceptable excuse, it is not permissible to do so, because it will harm the wife, and because both do not live any of the matrimonial life and its meanings, which favors the option of annulment. The safety of psychological stability generally does not conflict with the pursuit and requirement of safety measures in the submission of its obligations by the option of dissolution through litigation proceedings. Therefore, the study examined the meaning of the absence and the conditions of separation in addition to the opinions of jurists in the legality of the judicial annulment due to absence and concluded the role of the judge and his authority in the process of proceedings, its evidence and judgment.
