المستخلص: موضوع البحث: جرائم المعلوماتية والقيم الواقية منها في النظام السعودي. أهداف البحث: تجلية ماهية الجرائم المعلوماتية، والقيم الواقية منها، وبيان حالاتها، والكشف عن البناء القيمي الذي أقيم على أساسها في النظام السعودي، ودور تلك القيم في الحد منها والقضاء عليها، وإبراز عظم الجهود التي تضطلع بها المملكة العربية السعودية في نظام مكافحة جرائم المعلوماتية. منهج البحث: الاستقرائي الوصفي. أهم النتائج: • يستند نظام مكافحة جرائم المعلوماتية السعودي إلى روح الشريعة الإسلامية • تتحمل المملكة العربية السعودية مسؤولياتها الكاملة تجاه المحافظة على أمن معلومات الوطن، والمواطنين. • تأخذ مواد نظام مكافحة جرائم المعلوماتية قضية سلامة أفراد المجتمع السعودي ماديا ومعنويا على محمل الجد، وينعكس ذلك في درجات العقوبات المنصوص عليها لمقترفي الجرائم المعلوماتية. • يكشف النظام عن رحابة صدر الدولة في استيعاب التائبين والعفو عنهم في مجال الجرائم المعلوماتية شريطة تعاونهم التام معها. • ينبه النظام إلى ضرورة التعاون لضبط المجرمين، وتجفيف منابع الجرائم المعلوماتية. • يوقع النظام على أصحاب الجرائم المعلوماتية العقاب المعنوي، والمادي في آن واحد. أهم التوصيات ضرورة دراسة أنظمة المملكة العربية السعودية، وخاصة نظام مكافحة جرائم المعلوماتية، على نحو مستفيض، وبيان بنيتها القيمية، والقانونية، وأسسها الشرعية، وبثها في أوساط المثقفين، ليكونوا عونا للدولة، ويتحملوا جزءا من مسؤوليتهم نحو وطنهم

Research Subject: Information Crimes and the Protective Values therefrom in the Saudi Law. Research Objectives: Clarifying the essence of information crimes and the protective values therefrom, explain the cases thereof, discover the value structure based thereon in the Saudi Law, the role of such values in mitigating such crimes and highlighting the great efforts exerted by the Kingdom of Saudi Arabia in combating the information crimes. Research Methodology: Descriptive Inductive. Research Results: • The Saudi Law for combating information crimes is driven from Islamic Sharia. • The Saudi Law for combating information crimes is driven from Islamic Sharia. • The Kingdom of Saudi Arabia assumes the full responsibility thereof towards preserving the nation’s security. • The articles of the Law for combating information crimes take the protection of the Saudi community members’ safety, morally and materially, into serious consideration. This is obvious because of the levels of the stipulated punishments for the information criminals. • It is clear that the Law shows the State’s tolerance in incubating and forgiving the repentant who committed information crime, provided that they demonstrate full cooperation with the State. • The law drags the attention to the need for cooperation to arrest the criminals and mitigate the sources of information crimes. • The law imposes punishments on the information criminals, morally and materially at the same time. Main Recommendations: It is necessary to study the KSA laws, especially the law for combating the information crimes, in detail. Moreover, to explain the value and legal structure of such laws besides the Sharia basis thereof. Such laws shall be communicated among intellectuals so that they may give a hand to the state and bear a part of their responsibility towards their nation.
