|a قد تطرأ ظروف استثنائية معينة تنتقل فيها سلطات الضبط الإداري من شرعية الالتزام بالقوانين إلى مشروعية إدارة الأزمات في ظل ظرف استثنائي يهدد المصلحة العامة، حتى وإن كانت هاته الظروف استثنائية وقتية وزمنية وليست مطلقة، إلا أن لها من آثار بالغة وانعكاسات على الصالح العام لا سيما ثلاثية النظام العمومي (الأمن العام، السكينة العمومية، والصحة العمومية) من جهة. ومن جهة أخرى على ممارسة الحقوق والحريات العامة للأفراد المكرسة دستوريا، ذلك ينبغي أن تمارس تحقيقا للمصلحة العامة وحفاظا على النظام العام، ووفق لشروط وضوابط القانون. ولعل انتشار فيروس كورونا كوفيد 19 - شكل ظرفا استثنائيا الأمر الذي فرض ضرورة ممارسة سلطات الضبط الإداري للحفاظ على الصحة العمومية تحقيقا للمصلحة العامة حتى وإن قيدت الحقوق والحريات العامة.
