المستخلص: تهدف جراحة التجميل التحسينية إلى تغيير الشكل الخارجي للإنسان، بتجميل هيئته أو تحسين مظهره. ولأنها تخلو من غاية العلاج، وتتم في ظروف مثالية فيلزم إخضاعها لأحكام خاصة تتسم بالتشدد. وقد أبرزت هذه الدراسة الموسومة "خصوصية واجب التبصير في جراحة التجميل التحسينية" أخص مظاهر التشدد التي تتسم بها هذه الجراحة، وهو واجب التبصير. فتناولت في أربعة مباحث وجوب توجيه التبصير من الجراح نفسه المدين به، إلى العميل نفسه الدائن به. وثانيا في اعتباره التزاما بتحقيق نتيجة. ثم في محتوى التبصير الذي يجب أن يشتمل على كل ملابسات التدخل الجراحي، ما تعلق بالتشخيص أو بالمخاطر التي قد تنجم عن العملية، بما فيها المخاطر الاستثنائية نادرة الحدوث، وبالمضاعفات والآثار التي تترتب على هذه الجراحة. وأخيرا تحميل الجراح عبء إثبات أدائه لهذا الواجب على الوجه المعتبر. وذلك من خلال بيان مضمون التشدد ومقتضياته ومسوغاته ودلائله، ثم فحص إمكانية تبنيه في أي تنظيم يتناول جراحة التحميل في المملكة العربية السعودية.

The Importance of Enlightening on Aesthetic Plastic Surgeries. Aesthetic Plastic Surgeries aim at changing the external appearance of a person, by beautifying or improve his/her body appearance. However, considering the fact that such surgeries are conducted for various cosmetic reasons rather than for the purpose of treatment; then, they must be subjected to special, strict regulations. Therefore, this study, which was titled: "the Importance of Enlightening on Aesthetic Plastic Surgeries", sought to highlight the extreme aspects of Aesthetic Plastic Surgeries, which should be clarified to the client; the duty of enlightening. In its four sections, the study shed light on the cases in which the surgeon conducting the Aesthetic Plastic Surgery is required to enlighten the client on the surgery s/he seeks. The researcher stressed the fact that the surgeon owes the client an enlightening explanation of the operation ahead of it. Secondly, the study explored the implied agreement between the surgeon and the client that the surgery should give certain results. Afterwards, the study identified the aspects on which the client should be enlightened, such as: the circumstances in which surgical intervention should be sought; the diagnosis given in such cases or the risks that may result from the operation, including the rare risks as well; and the complications and other repercussions that may result from such surgeries. Finally, the study investigated whether the surgeon bears the burden of proving that he has performed his duties in the appropriate manner. Therefore, the study attempted identifying what is meant by extreme aesthetic surgery; defined the term, and listed its requirements, justifications and indications. Further, it proposed adopting a strict approach towards conducting aesthetic surgery in any organization offering plastic surgery in the Kingdom of Saudi Arabia. At the end, the study, which came as comparison to relevant French laws, concluded with a number of results and recommendations.
