تناول موضوع التبني كان من الأهمية بمكان ولم تقتصر هذه الأهمية على مجال معين وما يؤكد ذلك التصدي لموضوع التبني في الشريعة الإسلامية والمجتمعات القديمة والشرائع السماوية والقوانين المقارنة نظرا للآثار الخطيرة التي كانت تترتب على التبني من اختلاط الأنساب ومخالفة قواعد الشريعة الإسلامية وانتهاك المحرمات وحرمة الزواج بين من تربطهم قرابة بالتبني وبالتالي فقد تأكد من خلال بحث موضوع التبني الآثار الضارة التي تترتب على التبني. وكانت دراسة موضوع التبني تاريخية وشرعية ومقارنة لأن التبني معروف منذ العصور البدائية الأولي وقد استمر التبني خلال الأزمنة التاريخية المختلفة وما ا زل حتى الآن رغم آثاره الضارة وقد حاول البحث التعرض للجوانب المختلفة لموضوع التبني مؤكدا على ضرورة القضاء على التبني وكيف عالج الإسلام الحنيف المشكلات التي كانت تترتب على التبني حفاظا على المجتمع وعلى الأسرة وعلى كفالة ورعاية كل الأفراد وكيف تم وضع العديد من الحلول لمشكلات التبني. وتم تناول موضوع التبني في القانون الروماني حيث تم الوقوف على أحكامه ونظمه وأنواعه وكيف كان يتم ومدي تأثر المجتمعات بنظام التبني في القانون الروماني. وقد كانت دراسة البحث تتسم بالمنهجية بهدف تأصيله وتحليله من النواحي القانونية والتاريخية والشرعية حتى يلم القارئ بصورة مبسطة وشاملة لكافة جوانب موضوع التبني. وقد انتهي البحث ببيان ما يؤدي إليه التبني من أضرار بالمجتمع وكيفية معالجة هذه الأضرار حتى تستقيم الأمور وينصلح الحال ويتم ترك الموبيقات وقد اتجه المشرع نحو تلاشي مضار التبني والعمل على معالجة أثارة الضارة بالمجتمع. وبالتالي لم يقتصر تحريم التبني على الشريعة الإسلامية فحسب وإنما اتجهت للتشريعات المختلفة نحو الحد من التبني والتأكيد على عدم إتباعه وإلغاءه.
Addressing the subject of adoption was of great importance and this importance was not limited to a particular area and this is confirmed by addressing the issue of adoption in Islamic law , ancient societies, heavenly laws and comparative laws due to the serious effects of adoption of the mixing of genealogy violation of Islamic Law rules, violation of taboos and inviolability of marriage between those who have a kinship of adoption, and therefore has been confirmed through the consideration of the subject of adoption the harmful effects of adoption and the study of the subject of adoption was historical, legal and comparative because Adoption has been known since early times and adoption has continued during different historical times and adoption is still despite its harmful effects . The research tried to expose the different aspects of the subject of adoption, stressing the need to eliminate adoption, how Islam addressed the problems that arising from adoptionin order to preserve society and the family and to ensure and care for all individuals and how many solutions were developed for adoption problems and addressed the subject of adoption in romantic law where its provisions, regulations and types were identified and how societies were affected by the adoption system in Romanian law, and the research study was systematic with the aim of rooting it out and analyze it from the legal aspects so that the continental learns in a simplified and comprehensive way to all aspects of the subject of adoption and the research ended by showing the damage caused by adoption to the society and how to deal with these damags until things are right and the money is fixed and the favors are left and the legislator has turned towards the disappearance of the harms of adoption and work to address the effects of the car in society . Consequently, the prohibition of adoption was not limited to Islamic law, but various legislation sought to limit adoption and emphasize that it was not followed and abolished.
