المستخلص: في بحثنا هذا، نقوم بالتركيز على نشأة النظام الفيدرالي الاتحادي والذي تبنته الدول المعاصرة في نهاية القرن السادس عشر، وعلى صدارتها الولايات المتحدة الأمريكية والتي برز دورها المثالي في تبني هذا النظام الإداري والسياسي وأثبت نجاحه في تحقيق طموح شعوب ولاياتها والحفاظ على أراضيها ومصالحها العامة، ودول أخرى استفادت من تطبيق هذا النظام الرائد. ثم نذكر التعاريف التي وردت في تعريف وفهم المقصود من الفدرالية، نبحث في منشأ فكرة الفيدرالية والعوامل التي ساهمت في نشأتها، وكيفية تطبيق الدول لها وكيف أنها تختلف من دولة إلى أخرى حسب واقع كل دولة وطبيعة شعوبها وموقعها الجغرافي، ونأتي ببعض النماذج من الدول التي تبنت هذا النظام بشيء من الشرح، وندخل في المظاهر التي تميز هذا النظام عن غيره من الأنظمة، وعن دستور الدول الفيدرالية ونبحث عن آليات عمل سلطات الأنظمة الفيدرالية، ونبحث عن التحول الفيدرالي لنظام الحكم في العراق وأخيرا الأساس القانوني لإقليم كوردستان والذي كان من العوامل الرئيسية في نشأة النظام الفيدرالي الاتحادي العراقي.

In our research, we focus on the emergence of the federal system, which contemporary countries adopted at the end of the sixteenth century, and on the leadership of the United States of America, whose exemplary role in adopting this administrative and political system emerged and proved its success in achieving the aspiration of the peoples of their states and preserving On their lands and public interests, and other countries benefited from system. Then we mention the definitions that came in the definition and understanding of what is meant by federalism, we look at the origin of the idea of federalism and the factors that contributed to its establishment, and how states implement it, and how it differs from one country to another according to the reality of each country and the nature of its people and its geographical location, and We come with some examples from countries that have adopted this system with some explanation, and we enter into the aspects that distinguish this system from other systems, and the constitution of the federal states, and we are looking for mechanisms for the work of the authorities of federal systems, and we are looking for the federal transformation of the system of government in Iraq and finally, the legal basis for the Kurdistan region and which was one of the main factors in the genesis of the federal system in Iraq.
