المستخلص: تزايدت أهمية الغاز الطبيعي في السنوات الأخيرة مع تزايد حجم الاكتشافات منه وقد تزامن ذلك مع تزايد معدلات استخدامه لقلة تأثيره بيئيا ونظافته وتنوع أساليب ونوعية استخدامه. وتتنوع الأنشطة اللوجستية التي تتم في إطار صناعة الغاز، أو (سوق الغاز) سواء على المستوى الدولي أو المحلى وعليه تتنوع التنظيمات القانونية التي تنظم تلك الأنشطة. ومن أهم الأنشطة التي تتم في إطار سوق الغاز: الأنشطة الاستخراجية، البيع والتداول، النقل وطرق الإمداد، التخزين، التوزيع وهي أنشطة هامة تشكل أهمية كبرى في صناعة الغاز وسوق تداوله، وهي أنشطة اعتبرها قانون التجارة المصري رقم ١٧ لسنة ١٩٩٩ من الأعمال التجارية الاحترافية والتي أفرد لتنظيم عقودها نصوصا عديدة وضعت الإطار العام لتلك العقود التجارية. وجدير بالذكر الإشارة لانضمام مصر إلى منتدى غاز شرق المتوسط بموجب قرار رئيس الجمهورية رقم ٦٤٤ لسنة ٢٠٢٠ وقد جاء ذلك ضمن الخطوات التي تتخذها مصر كي تصبح مركزا إقليميا عالميا لتداول الغاز والطاقة في شرق المتوسط، على الأخص مع وجود بنية تحتية لصناعة الغاز تفتقدها المنطقة مثل محطات إسالة الغاز في إدكو ودمياط والتخطيط نحو مد خطوط أنابيب غاز جديدة يتزايد معها ضرورة تنظيم تجارة وتداول (الغاز الترانزيت). ولكل ما تقدم عرضه وجد المشرع نفسه أمام ضرورة ملحة لتنظيم سوق الغاز في مصر وأنشطته المختلفة والتوجه نحو تحرير هذه السوق وجعلها سوق تنافسية تليق بالمستقبل الواعد لهذه الصناعة. وبالفعل صدر القانون ١٩٦ لسنة ٢٠١٧ بتنظيم أنشطة سوق الغاز، وتبعته اللائحة التنفيذية للقانون بوجب قرار رئيس مجلس الوزراء رقم ٢٣٩ لسنة ٢٠١٨ ليكتمل بذلك النظام الخاص لسوق الغاز والأنشطة التي تمارس في إطار، ومن هنا تبدو الإشكالية في استيضاح ورسم ملامح التنظيم القانوي لسوق الغاز في مصر وصولا به إلى نقطة التحرير في ظل حماية المنافسة التجارية في ظل التشريع الحديث سالف الذكر وندرة الأحكام القضائية والأبحاث المنشورة في هذا الموضوع لحداثته.

The importance of natural gas has increased in recent years with the increasing volume of discoveries of it, and this coincided with the increasing rates of its use due to its low environmental impact, its cleanliness, and the diversity of methods and quality of its use. The logistical activities that take place within the framework of the gas industry or (gas market) vary, whether at the international or local level. Accordingly, the legal regulations regulating these activities vary. Among the most important activities that take place within the framework of the gas market: extractive activities, selling and trading, transportation and supply methods, storage, distribution, which are important activities that are of great importance in the gas industry and its trading market. He singled out several texts for organizing its contracts that set the general framework for those commercial contracts. It is worth noting that Egypt joined the Eastern Mediterranean Gas Forum pursuant to Presidential Decree No. 644 of 2020, and this came as part of the steps that Egypt is taking to become a global regional center for gas and energy trading in the Eastern Mediterranean, especially with the presence of an infrastructure for the gas industry that the region lacks, such as gas stations. Liquefaction of gas in Idku and Damietta, and planning towards laying new gas pipelines, increases the necessity of regulating the trade and circulation of (transit gas). For all of the foregoing presented, the legislator found himself facing an urgent need to regulate the gas market in Egypt and its various activities and to move towards liberalizing this market and making it a competitive market worthy of the promising future of this industry. Indeed, Law 196 of 2017 was issued regulating the activities of the gas market, followed by the executive regulations of the law pursuant to Prime Minister Decree No. 239 of 2018 to complete the special system of the gas market and the activities practiced within the framework. Hence, the problem arises in clarifying and drawing the features of the legal regulation of the gas market in Egypt, to It reached the point of liberation in light of the protection of commercial competition in light of the aforementioned modern legislation and the scarcity of judicial rulings and research published on this subject due to its recentness.
