|a يعتبر إلحاق النسب في العلاقات غير المشروعة سواء كانت زنا أو اغتصاب من بين المسائل الخلافية، التي يصعب فيها ترجيح الكفة للجواز أو الحظر لقوة أدلة كلا الفريقين من الناحية الشرعية، فجمهور الفقهاء وهم القائلين بالحظر ساقوا أدلة قوية خاصة العقلية منها، والشريق الثاني أيضا أبدع في تفسيره لأدلته خاصة ما تعلق بالقياس، والدليل النقلي الوحيد الذي لا يمكن الطعن فيه باعتباره حديث صحيح هو معتمد كلا الفريقين. والمشرع الجزائري أيضا لم يفصل في المسألة فغياب السند القانوني أدى إلى اختلاف الاجتهاد القضائي بدوره بين مجيز ومانع، لكن ما يلحق بالمولود من ضياع وتهميش يجعلنا ننتصر للقائلين بالإلحاق.

It is related to analogy and the only transitional evidence that cannot be challenged as a true hadith is the author of the two parties, and the Algerian legislator also did not decied on the issue, as the absence of the legal basis led to a difference in the judicial jurisprudence also between permissible and impediment, but what is attached to the newborn in terms of loss and marginalization makes us triumph for those who say the attachment.
