المستخلص: نحاول من خلال هذه الدراسة تسليط الضوء على أسس الرقابة الدستورية في أحكام التعديل الدستوري الجزائري لسنة 2016، لذلك ارتأيت أن أتناول الموضوع على مبحثين، في المبحث الأول أبرز جديد تطور الهيئة الممارسة للرقابة على دستورية القوانين، أما في المبحث الثاني فسأتناول نطاق الرقابة الدستورية بالجزائر والآثار المترتبة عنها، مبرزا دور المجلس الدستوري في مجال الرقابة وكذا الآثار التي ترتبها قراراته على ما طعن فيه بعدم الدستورية والقيمة القانونية لهذه القرارات. وأختم هذه الدراسة بإبراز أهم النتائج المتوصل إليها والتي رتبها التعديل الدستوري لسنة 2016 لعل أبرزها تأكيده على أن الرقابة الدستورية هي اختصاص أصيل للمجلس الدستوري ثم توسيعه تشكيلة المجلس الدستوري ووضعه شروط للترشح لعضوية المجلس، بالإضافة لتوسيع دائرة من لهم حق إخطار المجلس الدستوري، وكذا تبنيه أسلوب الرقابة عن طريق الدفع بعدم الدستورية.

My studies aim to shed light on the foundations of constitutional oversight in the provisions of the Algerian constitutional amendment of 2016. Thus, I dealt with the topic in two chapters. In the first one, I highlighted the new mechanism of the work of the Constitutional Council as an institution exercising control. Then I dealt with the right of individuals to appeal unconstitutionality. As for the second chapter, I dealt with the scope of constitutional oversight in Algeria and its effects, highlighting the competencies of the Constitutional Council in the field of oversight as well as the implications of its decisions for what was appealed by the unconstitutionality and the legal value of these decisions. I conclude this study by highlighting the most important results that were arranged by the constitutional amendment for the year 2016, the most prominent of which is its assertion that constitutional oversight is an inherent competence of the Constitutional Council and then it expanded the composition of the Constitutional Council and set conditions for candidacy for membership in the Council, in addition to expanding the circle of those who have the right to notify the Constitutional Council, as well as adopting monitoring methods by expressing the exception of unconstitutionality.
