المستخلص: يتلخص هذا البحث من حيث أن فيه بيان المراد بفقه الحديث وأهميته وعناية علمائنا به، وكذلك بيان فقه الواقع وأهميته وكيف نصل له، وأن الحديث النبوي صالح لكل زمان ومكان، وأننا في هذا العصر وفي كل عصر لا نستغنى عنه، فهو النبراس الذي نقتدي به ونهتدي به، ولا شك أن للحديث النبوي فقها قد لا يدركه كل أحد، كما أن لكل عصر فقها قد لا يدركه كل أحد، ولكل منهما سبلا معينة لمعرفة كل منها وتطبيق كل منهما على الآخر، والأهم من ذلك السبل التي ينبغي أن يحيط بها المتخصصون بالسنة النبوية خصوصا، وعلماء الأمة عموما، لكي يطبقوا الحديث على الواقع، ومعرفة أن للسنة النبوية فقها ينبغي أن يراعيه العلماء، فجاء هذا البحث يبين بعض هذه السبل المعينة لفقه الحديث من خلال استقراء كتب السنة وشروح العلماء وكتب الفقهاء، وذكر أمثلة جاءت بها السنة النبوية، وذكر كيف طبقها العلماء على واقعهم، من السلف الصالح من عهد الصحابة رضي الله عنهم، والتابعين لهم بإحسان، ومن بعدهم علماء الأمة في جميع العصور، وأن هذا الأمر ليس بدعا أو أمرا محدثا، ولكن لكل زمان مشكلاته ومستجداته المتغيرة، فهذا البحث من باب شحذ الهمم لمواجهة مثل هذه المستجدات في عصرنا وفي كل عصر، وليعلم أن الحديث يطبق على كل واقع.

This research is summarized in that it contains a statement of what is meant by the jurisprudence of hadith and its importance and the care of our scholars about it, as well as a statement of the jurisprudence of reality and its importance and how to reach it, and that the Prophet’s hadith is valid for every time and place, and that we are in this age and in every age we do not dispense with it, it is the beacon that we emulate and we are guided by. There is no doubt that the Prophet’s hadith has a jurisprudence that may not be understood by everyone, just as every era has a jurisprudence that may not be understood by everyone, and each of them has specific ways to know each of them and apply each to the other, and most importantly, the ways that specialists in the Prophetic Sunnah should be surrounded in particular. And the scholars of the Ummah in general, in order to apply the hadith to reality, Knowing that the Sunnah has jurisprudence that scholars should take into consideration, then this research shows some of these specific ways of jurisprudence of hadith through extrapolating the books of the Sunnah, the explanations of scholars and the books of jurists, and mentioning examples brought by the Prophetic Sunnah, and mentioning how the scholars applied it to their reality, from the righteous predecessors from the era of the Companions May God be pleased with them, and those who follow them in goodness, and after them the scholars of the nation in all ages, and that this matter is not an innovation or a newly invented matter, but every era has its problems and its changing developments. The hadith applies to every reality.
