المستخلص: يعتبر النسب لحمة شرعية بين الأب وولده تنتقل من السلف إلى الخلف، ويثبت بوسائل ذات حجية ظنية ووسائل ذات قيمة قطعية، ويشرف على هذه العملية القضاء. ورغم أهمية إلحاق الولد بأبيه على الصعيد الأسري والاجتماعي...، إلا أن المشرع أطلق العنان أمام القاضي في الأخذ بالطرق العلمية من خلال عدم تقييده باللجوء إليها رغم أنه يمكن أن توصله إلى نتائج شبه مؤكدة لاسيما طريقة تحليل الحمض النووي. ومنحه بذلك الحرية المطلقة دون قيد أو شرط في إتباع الوسائل الحديثة من عدمه، ما يبرر عدم ضمان حماية حقيقية وجدية وكافية للولد والأسرة والمجتمع ككل، إذ يترتب جراء ذلك ضياع مصير حقوق الولد من روابط أسرية وميراث إن كان لها ما يبررها. لذلك كان حريا بالمشرع أن يعمل على إلزام القاضي باللجوء إلى الطرق العلمية في كل الأحوال التي تستلزم ذلك وغلق باب التقدير المطلق في وجهه لأن إسناد النسب لأهله ليس على القاضي بعزيز.

Filiations a legitimate tie between the father and his son transmitted from the ancestor to the successor. It is proved by means of presumptive authority and means of absolute value. This process is supervised by the judiciary body. Despite the importance of joining the child with his father at the family and social level, the legislator gave absolute freedom to the judge to adopt scientific methods, by not restricting him to resort to them, despite the fact that this could lead him to almost confirmed results, especially the method of analyzing the DNA. By that the legislator granted the judge absolute freedom- no restrictions or conditions in following the modern means or not. This justifies the non-guaranteeing real, serious and adequate protection for the child, the family and society as a whole, as this results in the loss of the fate of the child's rights in terms of family ties and inheritance if they are justified. Therefore, the legislator should have worked on obligating the judge to resort to scientific methods in all cases that necessitate this, and to close the door of absolute appreciation for him since assigning filiation to its family is not difficult for the judge.
