المستخلص: كرس قانون المنافسة الصادر بموجب الأمر 03- 03 المؤرخ في 19 يوليو 2003 المعدل والمتمم بالقانون 10- 05 المؤرخ في 15 غشت 2010 مبدأ حظر الممارسات والأعمال المدبرة باعتبارها شكل من أشكال الممارسات التي تؤدي إلى عرقلة السير الطبيعي للقواعد التنافسية للسوق، والتي تشمل كل الأنشطة الاقتصادية والمتمثلة في الإنتاج والتوزيع والخدمات وعلى وجه الخصوص الصفقات العمومية، وذلك بدء بنشر الإعلان عن المناقصة إلى غاية المنح النهائي للصفقة.

La loi relative à la concurrence promulguée par l'ordonnance 03-03 du 19 juillet 2003 modifier et compléter par la loi 10-05 du 15 Aout 2010 a consacré le principe de l'interdiction des pratiques et des actions concertées comme une forme de pratiques qui entravent le fonctionnement naturel des règles du marché, et qui concerne toutes les activités économiques: la production, la distribution et les services et plus particulièrement les marchés publics à partir de la publication de l’avis d’appel d’offres jusqu'à l’attribution définitive du marché.

The Competition Law promulgated by Ordinance 03-03 of July 19, 2003, amended and supplemented by Law 10-05 of August 15, 2010, established the principle of prohibiting deliberate practices and acts as a form of practices that lead to obstructing the normal functioning of the competitive rules of the market, which includes all economic activities represented in production, distribution and services, and in particular public deals, starting with publishing the announcement of the tender until the final award of the deal.
