|a يقصد بمحفوظات البعثة الدبلوماسية، جميع وثائق البعثة الدبلوماسية سواء أكانت مكتوبة أم مسجلة أم مصورة في شكل صور أو أفلام، وكذلك جميع كتبها وسجلاتها ومعدات التشفير والترميز وفهارس البطاقات، وكل قطعة من الأثاث المعد لحفظ هذه الأشياء أو المحافظة عليها. ومما لا شك فيه أن المحفوظات الدبلوماسية تحمل أسرار الدولة، وبالتالي لابد من تمتعها بالحصانة. وتكمن أسباب تمتع المحفوظات والوثائق بالحصانة في إمكانية وجود هذه المحفوظات والوثائق في غير أماكن المقرات الدبلوماسية، هذا بالإضافة إلى أنه يمكن أن يسمح في بعض الحالات للسلطات المحلية بدخول المقرات الدبلوماسية بموافقة رئيس البعثة، لضرورات معينة، وبالتالي فقد ثار الخلاف حول طبيعة المحفوظات الدبلوماسية ومدى تمتعها بالحصانة الدبلوماسية، فهل هي مستمدة من فكرة سيادة الدولة أو من حصانة المبعوثين الدبلوماسيين أو من مقر البعثة الدبلوماسية. لذلك سيشمل نطاق هذا البحث المقصود بالمحفوظات الدبلوماسية وأوجه الحماية العامة والخاصة لها.
