|a "مع التطور التكنولوجي السريع في عالم الاتصالات وتقنية المعلومات، شهد العالم أجمع تزايدا ملحوظا في عدد متصفحي الشبكة المعلوماتية ومستخدمي وسائل التواصل الاجتماعي، لاسيما أنها ليست حكرا على فئة معينة بل هي متاحة للجميع مما سهل الوصول إليها، وكبقية وسائل الاتصالات الحديثة، قد يحسن استخدام الشبكة المعلوماتية أو وسائل تقنية المعلومات من قبل البعض وقد يساء استخدامهما من البعض الأخر فيستغلها في ارتكاب الجرائم كالسب والقذف معتديا على كرامة الأشخاص وشرفهم واعتبارهم. تهدف هذه الدراسة إلى تحديد الأحكام والقواعد القانونية واجبة التطبيق حال ارتكاب جريمتي السب والقذف باستخدام شبكة الإنترنت أو وسائل تقنية المعلومات، مع توضيح موقف القانون الكويتي وموقف القوانين المقارنة من هاتين الجريمتين، بالإضافة إلى دراسة السياسة العقابية المتبعة من قبلهم، وعليه فقد تصدينا لأهمية العلانية ودورها في قيام هاتين الجريمتين ومدى توافرها في الشبكة المعلوماتية ووسائل تقنية المعلومات، وتعزيز ذلك بالتطبيقات القضائية الكويتية والإماراتية والفرنسية."
|b With the rapid technological development in the world of communications and information technology, the whole world has witnessed a noticeable increase in the number of information network and social media users, especially that it is not restricted to a specific (or particular) category, but it is available to everyone, which makes it easy to access (or which makes it easily accessible). Like other modern means of communication, the use of the information network or the means of information technology may be well used by some users, and they may be misused by others, by exploiting them to commit crimes such as insulting and defaming, attacking the dignity, honor and consideration of people. This study aims to determine the legal provisions and rules that should be applied when insulting and defamation are committed by using the Internet or information technology with clarifying the position of Kuwaiti law and the comparative laws on those two crimes in addition to studying the punitive policy followed by them. Accordingly, we will discuss the importance of the publicity and its role in the establishment of these two crimes and the availability of the publicity in the information network or the means of information technology and enhancing that by Kuwaiti, Emirati and French judicial applications.
