المستخلص: تناول هذا البحث المقومات الأساسية للدولة المعاصرة، وفي سبيل ذلك تم التعرض لسيادة القانون وسمو الدستور كأحد مقومات الدولة في النظم المعاصرة، وذلك ببيان أثر مبدأ المشروعية وسمو الدستور على بناء الدولة المعاصرة، وبيان موقف الفقه الإسلامي من الاحتكام إلى الدساتير وسمو الدستور. كما تم التعرض لتحديد الهوية كأحد المقومات الأساسية للدولة، وموقف الفقه الإسلامي من عناصر تحديد هوية الدولة. واشتمل البحث على الحديث عن تحديد نظام الحكم وفقاً للعلاقة بين السلطات كأحد مقومات الدولة، وبيان العلاقة بين السلطات في نظام الحكم الإسلامي. كما تعرض البحث لقيام النظام السياسي على التعددية والتداول السلمي للسلطة كأحد مقومات الدولة الدستورية المعاصرة، وموقف الفقه الإسلامي من التعددية السياسية كأساس لنظام الحكم الديمقراطي. وأخيراً اشتمل البحث على الحديث عن التوازن بين الحرية الفردية والمصلحة الاجتماعية في الدولة الدستورية المعاصرة والفقه الإسلامي، كأحد المقومات الأساسية للدولة.

This research deals with the basic ingredients of the contemporary Country, To this end, sovereignty of law and The height of the constitution as one of ingredients of Country in contemporary systems were exposed, And by showing the impact of the principle of legality and The height of the constitution on building the contemporary Country, And a statement of the position of Islamic jurisprudence regarding the invocation of constitutions and The height of the constitution, The identification as one of the basic components of the Country, and the position of Islamic jurisprudence on the elements of state identification were also discussed. The research included talking about judgment system of government according to the relationship between the authorities as one of the components of the state, and clarifying the relationship between the authorities in the Islamic system of government. The research also presented the political system based on pluralism and the peaceful transfer of power as one of the ingredients of the contemporary constitutional Country, and the position of Islamic jurisprudence on political pluralism as a basis for the democratic system of governance. Finally, the research included talking about the balance between individual freedom and social interest in the contemporary constitutional state and Islamic jurisprudence, as one of the basic ingredients of the Country.
