تناول الباحث آراء العلماء في تعليل أحكام الشريعة الإسلامية، حيث ذهب أكثرهم إلى أنها معللة بمصالح العباد، وأنها تتغير حسب تغيير المصالح وتتجدد تبعا للحوادث والمستجدات، ولذا تصلح لكل زمان ومكان، إلا أحكام العبادات فإنها نادرة التغيير وأنها أميل إلى التعبد والالتزام، بينما ذهب بعضهم إلى أن أحكام الشريعة تعبدية لا يدخلها التعليل ولا القياس، فيجب على العباد التزام النصوص كما جاءت، وفي هذا جمود للشريعة وانتكاس، كما يهدف البحث إلى بيان صلاحية الشريعة لكل زمان ومكان وإن أحكامها شاملة لكل المستجدات، ثم توصل الباحث إلى عدة نتائج أهمها: أن الأصل في العبادات التعبد إلا ما نص الشارع على علته، والأصل في المعاملات التعليل والقياس، وإن تعليل الأحكام ثابت بالقرآن والسنة وفعل الصحابة رضوان الله تعالى عليهم، وعليه جمهور العلماء، وأنكره الظاهرية، وأخيرا أوصي الباحث بمراعاة التعليل والقياس في أحكام المعاملات لاستيعاب المستجدات، والتزام النصوص في أحكام العبادات وعدم التعليل إلا ما نص الشارع على علته لاستبعاد البدعة في الدين وعلى علماء المسلمين استنباط أحكاما مناسبة للمعاملات المستجدة وفقا لمقاصد الشريعة ومراعاة مصالح العباد.
The researcher handles the scholars opinions in justifying the Islamic Shriaa rules ,whereby most of them think that they are connected people interests and they changed according to the change of the interests and renew according to the events and the recent ,so they are valid for every time and any place. But the rules of worships are rarely changed and they tended to worship and obligation whereby some of them show that the rules of sharaa belong to worship without justification or measurement, so people must be obliged to it and in this, is inactivity and relapse. The research aims at showing the validity of shariaa for any time and any place and its rules included all the recent. The researcher has reached to many results, the most important of them are; The origin of worships is adoration except what the Legislator has approved its invalidity and the origin in the transactions is justification and measurement. And justification of the rules are fixed by Quraan and Suna and Sahaba action [peace be upon them] supported by the throng of the scholars and rejected by Zahiria. Finally, the researcher recommends the observation of the justification and measurement in transactions rules to absorb the recent and to be obliged by the texts in the rules of the worship and avoid justification, but only that the Legislator rejects to keep away. The heresy in religion and Muslim scholars must formulate suitable rules for the transactions according to Shariaa intentions and observing the interests of the people.
