|a تناول هذا البحث مفهوم القضايا النازلة، والضوابط التي وضعها الفقهاء قبل الحكم على النوازل الفقهية. وتهدف هذه الدراسة إلى بيان عدة أمور، وهي: أولا: بيان مفهوم القضايا النازلة. ثانيا: الوقوف على مناهج الفقهاء في القضايا النازلة. ثالثا: إبراز بعض القضايا التي شاعت في المجتمع الليبي ومدى انقسام الناس في الحكم عليها. وتكمن إشكالية البحث في التالي: 1-ما هو مفهوم القضايا النازلة؟ وما هي الضوابط التي وضعها العلماء في الحكم على النازلة؟ 2-ماهي مناهج الفقهاء في الحكم على النازلة؟ أما عن منهجية البحث فسأعتمد طريقة البحث الوصفي الاستدلالي للوصول إلى تحقيق أهداف البحث. وختمته ببعض النتائج التي توصلت إليها خلال هذا البحث، وبعض التوصيات التي يمكن الاستفادة منها عند البحث في المسائل الفقهية المعاصرة."
|b This study dealt with the concept of emerging issues and the controls established by the jurists before judging the jurisprudential decending. This study aims to do several things, namely: First, a statement of the concept of emerging issues. Secondly, to look at the jurists approaches to emerging issues. Finally, we highlight some of the issues that have spread in Libyan society and the extent to which people are divided in judging them. The problem of this study lies in the following questions:- 1-1- What is the concept of decending cases and what are the controls that scholars have set in judging the decending? 2-2- What are the jurists approaches to judging the decending ? As for the research methodology, I will adopt the descriptive method of which inference to reach the achievment of the objectives of the research. I concluded it with some results that I reached during the calming of the research and some recommendations that can be used when researching contemporary jurisprudential issues."
