هدفت الدراسة إلى الكشف عن قضايا النوازل المعاصرة من خلال توضيح قضية زواج المسيار في ضوء الكتاب والسنة. وانقسمت الدراسة إلى فصلين. الأول زواج المسيار وتضمن تعريف زواج المسيار. وبيان الفرق بينه وبين النكاح الشرعي وغيره من الأنكحة. وعرض للصور المشابهة لزواج المسيار في القديم. الثاني أقوال الفقهاء المعاصرين في زواج المسيار. وتضمن توضيح مذاهب الفقهاء والمعاصرين في حكمه وأدلتهم. ومعرفة أدله القائلين بعدم الإباحة ومناقشتها. وأدلة القائلين بالإباحة ومناقشتها. وتوضيح الراي الراجح في حكم المسيار. وجاءت النتائج مؤكدة على أن زواج المسيار زواج مستكمل الأركان والشروط والعقد فيه صحيح رغم تنازل المرأة عن بعض حقوقها إلا انه مخالف لمقاصد الشرع من الزواج. وأن زواج المسيار له بعض المزايا على رأسها إعفاف كثير من النساء العوانس والمطلقات والأرامل. ومساعدة الرجال في الحصول على الإعفاف والمتعة الحلال مع تخطي الزواج العادي الباهظة. ولكنه له العديد من المساوئ والآثار السلبية على الأسرة والمجتمع. إذ يستغله بعض الرجال في الحصول على المتعة فقط. وقد تشعر معه المرأة بالمهانة. ولا يتم فيه تربية الأولاد بصورة محكمة ومتكاملة. كما قدمت الرسالة مجموعة من النصائح منها أن الرجال الراغبين في العفة والمتعة الحلال عن طريق التعدد أن يسلكوا التعدد المعروف الذي شرعه لنا الله سبحانه وتعالى. وعلى النساء اللاتي يرغبن في الزواج القبول بصاحب الدين والخلق حتى لو كان متزوجا من أخرى أو فقيرا أو كبيرا في السن بعض الشيء.كُتب هذا المستخلص من قِبل دار المنظومة 2018



The study aimed to uncover contemporary issues of scourges by clarifying the issue of the misyar marriage in the light of the Book "Quran" and the Sunnah. The study was divided into two chapters; the first is the marriage of al-misyar, which includes the definition of the misyar marriage, clarifying the difference between it, legal marriage and other marriages, and showing of similar forms to the Misyar marriage long ago. The second chapter is the opinions of the modern scholars about the marriage of al-Misyar, which includes the clarification of the thoughts of contemporary jurists about its rule and evidence, the evidence of who say that it is not permissible and discussing them, the evidence of those who say that it is permissible and discussing them, and clarifying the preponderant opinion of the ruling of al-Misyar. The results confirmed that the Misyar marriage is fulfilling the elements and conditions and its contract is valid, despite the waiver of women of some of the rights, but it is contrary to the sharia's purposes of marriage. In addition, they confirmed that the marriage of al-Misyar has some advantages, especially to keep the purity of many unmarried, divorced and widow women, and to assist men in keeping purity with getting the lawful pleasure exceeding the expensive costs of the normal marriage. It also has many disadvantages and negative effects on the family and society as some men use it only for having the pleasure, but women may feel humiliated completely, as well as the children are not raised in a perfect and integrated manner. Besides, the study presented a set of tips, such as men who want to keep purity with lawful pleasure through pluralism to follow the known pluralism that God Almighty permitted. Moreover, women who wish to marry must accept the religious and moral educated husband even if he is married to another, poor or a little older..This abstract translated by Dar AlMandumah Inc. 2018
