المستخلص: ضعف تحرير المصطلحات إشكالية أدت إلى كثير من الخلاف والاختلاف في مواطن كثيرة من علم الكلام والأصول والفقه والتفسير وغيرها. ولذلك تم اختيار عنوان: "مفردة النكاح في الاستعمال القرآني وبيان المراد بها في قوله تعالى (حَتَّى تَنكِحَ زَوْجًا غَيْرَهُ)"، لأن مصطلح النكاح وقع الاختلاف في معناه عند اللغويين، وفي كلام الفقهاء، ومدلول بعض الآيات القرآنية والأحاديث النبوية. وقد تم التطرق في مباحثه ومطالبه إلى الحديث عن مفهوم النكاح في اللسان العربي، والاستعمال القرآني لمصطلح النكاح في ثلاثة وعشرين موطنا وردت في كتاب الله سبحانه. كما تم التطرق لكلام الفقهاء في معنى لفظة النكاح هذا في الجانب النظري أما الجانب التطبيقي فقد تناول البحث أقول المفسرين في قوله تعالى (حَتَّى تَنكِحَ زَوْجًا غَيْرَهُ) واستقراء كلامهم من قرابة مئة كتاب من كتب التفسير القديمة والحديثة شاملة لتفاسير كل الطوائف والمدارس الإسلامية. ومما تم تناوله في البحث أيضا: -الحديث المخصص للآية عند جمهور العلماء. -وقضية تخصيص القرآن بخبر الواحد وحاصل أقوال العلماء فيها. -كما تعرض البحث لبيان المقصد الشرعي من هذا الحكم. كل هذا بغية الوصول إلى صورة كاملة للمصطلح عبر رحلته التطورية ابتداء من الاستعمال اللغوي مرورا بالتناول الرباني والاستخدام الفقهي. وصولا إلى نموذج تطبيقي لكل ما مضى على مفردة النكاح في الآية القرآنية (حَتَّى تَنكِحَ زَوْجًا غَيْرَهُ) وللاستمرار في التطبيق اقتضى الأمر استقراء أقوال المفسرين وبيان حججهم مع التعريج على المخصص للآية وبيان درجته والتناول لقضية أصولية لها مساس بفهم الآية وهي: تخصيص القرآن بخبر الواحد منتهيا بذلك كله إلى بيان المقصد الشرعي من الآية بغية الوصول بالفهم للآية إلى الجمع بين الكلي والجزئي والجمع بين نص الآية وروحها. وقد آثرنا في كل ما سبق الإيجاز والاختصار لأن المساحة المتاحة لا تكفي لبسط الكلام والاسترسال فيه.

The weakness of editing terms is a problem that resulted in disagreement and differences in many areas of the science of discourse, jurisprudence, Quran interpretation and others. This paper is entitled " Marriage term in the Quranic usage and its meaning in the verse (until [after] she marries a husband other than him)” as the meaning of the term marriage is different among linguists, jurists and in the interpretation of some Quranic verses and prophet's traditions. This paper discusses the concept of marriage in the Arabic language and the Quranic use of the term in twenty-three places in Holy Quran. The paper starts with a theoretical part that presents jurists views on the meaning of the word marriage. The practical part deals with interpretations of in the verse (until [after] she marries a husband other than him) and extrapolates scholars’ views found in about 100 old and modern interpretation books that represent all Islamic sects and schools of thought. Other topics covered in the paper include: - The prophet's tradition that represents a specification of the verse from the perspective of the majority of scholars. - Scholars’ views on the specification of a Quranic verse by the use of prophet’s tradition that does not pass through many reliable transmitters at each point in the transmission chain. - The legislative purpose of this provision. The paper aims to form a full picture of the term through its evolutionary journey starting from the linguistic use to the divine approach and the jurisprudential usage for the purpose of developing a model for the interpretation of the term marriage in the verse (until [after] she marries a husband other than him). To fulfil this objective, it was necessary to extrapolate different interpretations and scholars' arguments in addition to discussing the chain of transmission of the prophe's tradition that specifies the verse and examining its authenticity. The paper discusses a jurisprudence issue relevant to understanding the verse which is the specification of a verse by the use of a prophet’s tradition that does not pass through many reliable transmitters at each point in the transmission chain up until the collection and transcription of the text. The purpose is to clarify the legislative purpose of the verse by combining the micro and macro meaning, the spirit and letter of the verse.
