|a اعتنت القوانين الوطنية وكذا الدولية بالمرأة من خلال منحها عدة امتيازات، فقد جاء قانون الأسرة الجزائري بعدة تغييرات منحت من خلالها للمرأة حرية تعاقدية، لأجل تكوين الأسرة، سواء في فترة الخطبة، باعتبار أن الرضا من الأركان الأساسية والإلزامية لإبرام عقد الزواج. أو في مرحلة إبرام عقد الزواج؛ إذ تكون المرأة حرة في إبرام عقد الزواج دون إجبارها أو إرغامها، وهذا حتى دون حضور وليها، كما مكنها المشرع الجزائري من حريتها وحقها في إنهاء العلاقة التعاقدية التي ترتب عنها الزواج وبناء الأسرة، إلا أن هناك قيودا ترد على هذه الحرية سواء في مرحلة إبرام عقد الزواج أو إنهاء هذه العلاقة، وتهدف هذه الدراسة إلى إبراز دور المرأة من خلال تحررها لأجل تكوين الأسرة، في خلق وتجسيد التنمية المستدامة باعتبارها المحور الرئيسي للتنشئة الاجتماعية السلمية للأجيال الصاعدة، وهذا متى منحت لها حقوقها بدون قيود، بذلك سيتم التطرق لأهم المحاور المرتبطة بمجال الأسرة وهذا وفقا لنصوص قانون الأسرة، وكيف عالج المشرع الجزائري مبدأ حرية المرأة من حيث إبرام عقد الزواج، وأيضا فك الرابطة الزوجية.
|b National as well as international laws have taken care of women by granting them several privileges, the Algerian Family Code has introduced several changes through which women have been granted contractual freedom, for the purpose of family formation, both during the period of sermon, since consent is a basic and compulsory basis for the conclusion of a marriage contract, or at the stage of the conclusion of a marriage contract; Women shall be free to enter into marriage without forcing or forcing them, even without the presence of their guardian, and the Algerian legislature has enabled them to break the contractual relationship resulting from marriage and family building. However, there are constraints to this freedom, whether at the time of the conclusion of the marriage contract or the termination of this relationship, which aim at highlighting the role of women through their emancipation for family formation, in creating and embedding sustainable development as the main focus of the peaceful socialization of rising generations. This is when their rights are granted without restriction, and the most important issues related to the family field will be dealt with according to the provisions of the Family Code, and how the Algerian legislature dealt with the principle of women's freedom in terms of marriage, as well as the dissolution of the marriage bond.
