يتميز منصب رئيس الجمهورية بأهميته في النظام البرلماني العراقي، وذلك لدوره المؤثر في التنسيق بين السلطتين التنفيذية والتشريعية، وكذلك مساهمته في الإجراءات التنفيذية من خلال إشراكه في كثير من الصلاحيات المهمة مع رئيس مجلس الوزراء، وبالتالي يعد الخلو في منصبه ذا أثر سلبي في الامتيازات الدستورية الممنوحة للسلطة التنفيذية، وبالتالي سريان العملية السياسية في الدولة. ونجد أن حالات خلو منصب رئيس الجمهورية تتعدد باختلاف أسبابها واختلاف فترة الخلو والتي قد تكون لمدة محدودة أو قد تستمر لمدة طويلة أو تكون بشكل دائم، ويلعب مجلس النواب الدور الكبير في تقرير حالة الخلو من عدمها، فضلاً عن تقريره لحالة الخلو إن كانت ينطبق عليها صفة الدوام أو التوقيت على الرغم من عدم النص على ذلك صراحة في دستور جمهورية العراق لسنة 2005، حيث تطرقت مواده إلى حالة الخلو في منصب رئيس الجمهورية بشكل مقتضب دون إن يميز بين حالاته أو أسبابه بصورة واضحة. وأيضا قد تختلف الجهات التي لها صلاحية الحلول محل منصب رئيس الجمهورية عند خلوه حسب وقت الخلو إن كان لرئيس الجمهورية نائب من عدمه، إذ يبرز دور رئيس النواب العراقي في الحلول بالمنصب عند عدم وجود نائب لرئيس الجمهورية، إضافة إلى وجود بعض التناقضات في مواد الدستور عند تنظيمها معالجة حالة الخلو التي قد لا تتلاءم مع طبيعة النظام السياسي المتبناة بموجب دستور النافذ لسنة 2005.
