من منطلق أن أحكام الشريعة مبناها مراعاة مصالح العباد في دنياهم وأخراهم، وأن أحكامها كلها قائمة على ذلك ما علمناه منها وما لم نعلمه؛ تحقيقا للمصالح ودرأ للمفاسد عن الخلق، جاء هذا البحث تحت عنوان: "الاجتهاد المقاصدي وأثره في مواجهة آفات المجتمع"، وقد قسمته إلى مقدمة، ومدخل مفاهيمي، وثلاثة مباحث، وخاتمة، وفهرس المصادر والمراجع، وفهرس الموضوعات. يهدف هذا البحث إلى التأكيد على أن الغلو والتطرف سبب رئيسي يقوض من استقرار المجتمعات، وضرورة تعظيم الاهتمام بقضايا ومشكلات الأسرة والمجتمع؛ ضمانا لاستقرار المجتمعات، وذلك من خلال إبراز فاعلية دور الاجتهاد المقاصدي في وحدة الصف واجتماع الكلمة، ونبذ الافتراق والخلاف، واستحضار مقاصد الشريعة عند تنزيل الأحكام في مواجهة آفات المجتمع، وبيان أن الاجتهاد المقاصدي لا ينبني فقط عند منطوق النص وحروفه، بل يتجاوز النص إلى الروح، والشكل إلى الجوهر، والمنطوق إلى المفهوم. From the premise that the provisions of Sharia are based on taking into account the interests of the people in their world and the hereafter, and that all its provisions are based on both what we are aware of and that we are not; seeking achievement of the interests and warding afflictions off people, this research came under the title: "Purposeful Diligence and its Impact on Confronting the Afflictions of Society", and it was divided into an introduction, a conceptual introduction, three sections, a conclusion, an index of sources and references, and an index of topics. This research aims to confirm that extremism and radicalism are a major reason that undermines the stability of societies, and the need to maximize attention to family and community issues and problems. In order to ensure the stability of societies, by highlighting the effectiveness of the role of intentional ijtihad in the unity of the class and the meeting of the word, and the rejection of separation and disagreement, and invoking the purposes of the Sharia when applying rulings in the face of the afflictions of society, and showing that the intentional ijtihad is not based only on the utterance of the text and its letters, but it aims beyond the text to the spirit, and from explicit speech to the implicitly understood meaning. |
