|a يعلق المتقاضي أمال كبيرة بلجوئه للقضاء لاستفاء حقه، وقد وفر له المشرع كل الضمانات القانونية لتسهيل ممارسة هذا الحق سيما في المادة الاجتماعية لبساطة الإجراءات وطبيعة الأحكام وطرق مرجعتها، لكن يبقى أهم عائق في تحصيل الحق هو التنفيذ لأن غاية العامل لا تتوقف في صدور حكم لصالحه وإعطاءه حقه، بل تكمن في تجسيده على أرض الواقع وفي سرعة تنفيذه من خلال وضع إجراءات قانونية تمكنه من اقتضاء هذا الحق خاصة وأمام تعنت الهيئة المستخدمة وتماطلها في تحقيق ذلك.
