المستخلص: " تعد اللغة - في أي مجتمع- ظاهرة من الظواهر الاجتماعية، ووسيلة من وسائل الاتصال بين أبناء هذا المجتمع، تتأثر دلالاتها بما يحيط بها من ظروف خارجية، تصاحب الحدث الكلامي، الذي يتكون من مجموعة عناصر، تؤثر في فهم وإيضاح المعاني، منها على سبيل المثال: حال المتكلم، وحال المخاطب وقت التعبير عن المراد. ولما كان (اعتبار الحال) عنصرا من عناصر دلالة السياق - الحدث الكلامي، له أثر في دلالة الحذف في الحديث النبوي، وخاصة أحاديث الأحكام ذات الصبغة التشريعية، لما تتميز به من مظاهر العموم، أو الخصوص، أو الإطلاق، أو التقييد...، وهو ما يتوقف على فهم المخاطبين، الذين هم المكلفون بهذه الأحكام، عني هذا البحث بإيضاح هذا الأثر من جهة، ومن جهة أخرى إيضاح ارتباط نظام بناء الجملة - بناء على حذف أحد عناصر التركيب باستنباط الحكم الشرعي."

"Language in any society is a social phenomenon, and a means of communication between the members of that society. The meaning of language is influenced by the external surrounding circumstances associated with the verbal event, which consists of a set of elements that affect the understanding, clarification, and implications. An example of this is the state of the speaker and the state of the receiver at the time of the exchange. The Hadith studies are the most noble and reputable source after the Holy Quran as it is a revelation from Almighty God, and interpretation of His Canon and provisions. It is necessary for the Muslim to understand and comprehend the Hadith as it the second source for the principles of Islamic legislation after the Holy Qur’an. ‘ The responsive condition’ is an element expressing the meaning of the context the verbal event – and has an effect on the significance of ellipsis in the Hadith of the Prophet, especially those of a legislative nature, because of its characteristics of generality or particularity; permission or prohibition ..., depending on the understanding of the audience who are entrusted with these rulings. So this paper is concerned with clarification of these effects, and it is also concerned with clarifying the connection of the syntax system based on the omission of one of the elements of the composition with the excogitation of the Sharia ruling."
