هدفت الدراسة للوقوف على أهم المقتضيات القانونية التي تعكس رؤية المشرع للتنمية والدور الذي يمكن أن تنوء به، وقد استعرضت القانون العقاري والمرسوم الساري المطبق له، والذين عكسا توجه المشرع نحو تكريس المنطلقات والمبادئ المؤسسة لمرحلة جديدة، واستغلال الأرض لأغراض الزراعة، فاهتم الأمر القانوني بإلغاء الملكية الجامعية وأكد احترامه للملكية الخاصة وأضاف أن الأحقية في التملك هي لمن يستغلون الأرض استغلالا يسهم في الإنتاج، كما اهتم المرسوم بتوضيح مساطر المنح وتحديد اللجان والمهام الموكلة لها، وأوضح المرسوم مرحلتي المنح المؤقتة والنهائية واشترط للانتقال من الأولى للثانية احترام شروط الاستثمار.
In this study, I tried to stand on the most important legal requirements that reflect the legislator's vision of development and the role that it can play, and I reviewed the real estate law and the applicable decree for it, which reflected the legislator's orientation towards dedicating the premises and principles establishing a new stage and the exploitation of the land for agricultural purposes, so he took care of the Ordinance He collective Ownership and his respect for private ownership. He added that the eligibility to own property is for those who exploit the land to contribute to production. The decree also took care of clarifying the procedures for grants and defining the committees and tasks entrusted to them. As for the code of real rights and the code of urbanization and the law regulating the real estate incentive, they came as an expression of a new phase that the legislator wanted to be a new opening and a revival of the important role of real estate at all investment and architectural levels, serving social goals and providing housing. Bypassing towards registration or real estate memorization, and the urbanization Law came with the three urban plans to contribute to drawing an urban plan that contributes to urbanization in a manner that serves development and improves the appearance of the city.
