المستخلص: أن أهمية الجوار لها أثر كبير في حياة الجماعة، وبذلك ما تقتضي به طبيعة الجوار من تصرفات تحتاج إلى بيان أحكامها. ومعرفة الالتزام الذي يقع على الجار في حالة حدوث ضرر للغير، وبالمقابل أن الضرر المتحصل يترتب عليه تعويض عندما تقام دعوى المسؤولية التقصيرية، فالتعويض من المواضيع المهمة لمعرفة كيفية جبر ذلك الضرر وكيف يتم تقديره وأي نوع من أنواع التعويض هو أصلح للمضرور بهدف فض النزاع الحاصل عن دعوى التلوث الضوضائي. فعندما تتوافر أركان المسؤولية التقصيرية الثلاثة (الخطأ والضرر والعلاقة السببية) ترتب حكمها وهو التعويض، ويعد التعويض وسيلة القضاء لجبر الضرر سواء كان ذلك بمحو الضرر أو تخفيفه ويدور مع الضرر وجودا وعدما وهو التزام قانوني يترتب على كل من تسبب بخطأ في ضرر للغير أن يعمل على جبر ذلك الضرر فتقام مسؤولية المطار التقصيرية عن التلوث وتترتب آثارها بتعويض المضرورين من التلوث الضوضائي.
