المستخلص: يندرج هذا المقال ضمن الحديث عن جرائم الاستعمار الفرنسي في الجزائر خلال الثورة التحريرية، ويتعلق الأمر هنا بالاستخدام الممنهج لشتى وسائل وأساليب التعذيب من قبل الجيش الفرنسي ضد الجزائريين رغم وجود اتفاقيات دولية لحماية حقوق الإنسان ومناهضة التعذيب. ولعل الإشكال المطروح في هذه الدراسة هو: كيف عملت فرنسا على شرعنه ممارستها للتعذيب في الجزائر خاصة خلال فترة الثورة التحريرية؟ ما التشريعات الاستثنائية التي سنتها وسمحت لها بممارسة التعذيب الفرنسي في الجزائر؟ هل هذه التشريعات قد كانت وليدة الفترة 1954-1962 أم أن لها جذور تعود إلى ما قبل ذلك؟ ثم إلى أي مدى نجحت هذه القوانين في تحقيق الأهداف الفرنسية في الجزائر؟ وما هي انعكاسات ذلك على الثورة الجزائرية؟ هذا ما سنجاول معالجته في هذا المقال.

This article is part of the talk about the crimes of French colonialism in Algeria during the liberation revolution. Perhaps the problem raised in this study is: How did France legitimize its practice of torture in Algeria, especial during the period of the liberation revolution? What extraordinary legislation has it enacted that has allowed it to practice French torture in Algeria? Was this legislation born in 1962-1954 or did it have roots in the past? To what extent have these laws succeeded in achieving French objectives in Algeria? What are the implications for the Algerian revolution? This is what we will try to address in this article.

Cet article fait partie du discours sur les crimes du colonialisme français en Algérie pendant la révolution: il s'agit de l'utilisation systématique de divers moyens et méthodes de torture par l'armée française contre des Algériens malgré l'existence de conventions internationales de protection des droits de l'homme et de lutte contre la torture. Le problème soulevé dans cette étude est peut-être le suivant: comment la France a-t-elle légitimé sa pratique de la torture en Algérie, en particulier pendant la période de la révolution? Quelle législation extraordinaire a-t-elle promulguée lui permettant de pratiquer la torture française en Algérie? Cette législation est-elle née en 1962 -1954 ou a-t-elle des racines dans le passé? Dans quelle mesure ces lois ont-elles réussi à atteindre les objectifs français en Algérie? C'est ce que nous allons essayer de traiter dans cet article.
