|a عنوان البحث هو التكييف القانوني لعقد التخصيص وفقا لنظام التخصيص الصادر مؤخرا في المملكة العربية السعودية بموجب المرسوم الملكي رقم م/٦٣ وتاريخ 5/8/1442هـ. ويهدف هذا البحث إلى تحديد نوع هذا العقد نظير أهميته وحداثته، والغاية من وراء ذلك تحديد الاختصاص القضائي للنظر في منازعات هذا النوع من العقود. وأهم نتيجة خرج بها هذا البحث أن عقد التخصيص هو "عقد إداري"، مما يعني انعقاد اختصاص النظر في منازعاته لديوان المظالم.
|b Research title is “The Legal Characterization for Privatization Contract according to Privatization Law issued recently in the Kingdom of Saudi Arabia under the Royal Decree No. M/63 dated 5/8/1442 H (18/3/2101 G).” This research aims at defining the type of such contract in terms of its importance and modernity. The purpose behind is to determine the jurisdiction competent to consider disputes of such type of contracts. The most important result came out of this research is that a Privatization Contract is an “Administrative Contract”, which means that the competent jurisdiction to consider the disputes of such a contract is the Board of Grievances.
