|a العدالة الانتقالية مفهوم حديث ومصطلح مركب، ارتبط بمرحلة إعادة البناء والإصلاح التي تقوم على جبر الضرر ورد الاعتبار وانتهاج المصالحة والمشاورات الوطنية كأحد أهم الآليات، التي يتم الاعتماد عليها من أجل إنجاح هذه المرحلة وتجاوز كل الانتهاكات الجسيمة لحقوق الإنسان، التي لحقت المجتمعات جراء الصراعات والنزاعات. فالعدالة الانتقالية تهدف إلى تحقيق سيادة القانون وإنشاء أسس الدولة الديمقراطية، وخلق الأمن والسلم الاجتماعي والمدني في المجتمعات التي مزقتها الصراعات. وفي هذا السياق عمدت الأمم المتحدة من خلال أجهزتها وقراراتها للتأكيد على تبني العدالة الانتقالية كخريطة طريق وبناء دولة القانون.
|b Transitional justice is a modern concept and a complex term, linked to the reconstruction and rehabilitation phase, which is based on reparation, rehabilitation, reconciliation and national consultations, as one of the most important mechanisms for the success of this phase and for overcoming the serious violations of human rights suffered by societies as a result of conflicts and conflicts. Therefore, transitional justice aims at establishing the rule of law, establishing the foundations of a democratic State and creating security and social and civil peace in conflict-torn societies. In this context, the United Nations, through its organizations and resolutions, has emphasized the adoption of transitional justice as a road map and the building of the rule of law.
