|a يعد دليل الإجماع من أهم الأصول التي يستند إليها في استنباط الأحكام الشرعية وإثباتها، وقد دل على صحة هذا الأصل أدلة من الكتاب العزيز والسنة النبوية وآثار الصحابة رضي الله عنهم. وأدلة الكتاب العزيز والسنة فهي مشهورة مذكورة في كتب أصول الفقه، وأما آثار الصحابة رضي الله عنهم فهي متفرقة في كتب السنة وقليل من الأصوليين من يستدل بها في إثبات الإجماع، فجاءت هذه الدراسة لإظهار هذا الاستدلال، حيث جمع فيها الباحث ما وقف عليه من آثار الصحابة الدالة على حجية الإجماع، وذكر فوائد الاستدلال بها، ومن استدل بها من أهل العلم، وبيَّن وجه دلالتها على الإجماع.
|b Consensus of the Prophet’s companions is one of the main principles employed for deducting and proving Islamic rulings. This has been proven in the Noble Qur’an and the traditions of Prophet and his companions. There are many textual evidence in the Qur’an and Sunnah mentioned in the books of Usool Al-Fiqh (Fiqh Theory). As to the traditions of the Prophet’s companions, they are scattered in the books of sunnah. Therefore, only few theoreticians use them for deductive reasoning about the probativeness of consensus. This study is conducted to follow this line of deductive reasoning. The author collected the relevant traditions of the prophet’s companions about the probativeness of consensus and explored the benefits of using them for deductive reasoning. He also listed the scholars who used it for deductive reasoning showing why it is a valid piece of evidence for consensus.
