المستخلص: تهدف الدراسة من هذا البحث إلى بيان المشتقات الحيوانية، واستخداماتها وحكمها الشرعي وبيان الضمان في صناعة الدواء المصنع من المشتقات الحيوانية. منهج البحث لقد نهجت في كتابة هذا الموضوع المنهج العلمي الاستقرائي، وذلك بتتبع المعلومات المتعلقة بمادة موضوع البحث من مظانها، كما اعتمدت على المنهج المقارن محاولة جمع آراء العلماء، والفقهاء فجعلت الآراء المتفقة في قول واحد يجمع بين أصحاب وحدة الرأي في المسألة الواحدة. كما قمت بعزو الآيات إلى سورها، وكذلك قمت بتخريج الأحاديث وفق المنهج العلمي في التخريج من الصحيحين فإن لم يكن في الصحيحين بينت درجة الحديث، والحكم عليه، كما ختمت هذا البحث بخاتمة ضمنتها أهم النتائج التي توصلت إليها في هذا البحث، وأخيرا: زيلت البحث بفهرس تفصيلي للمصادر، والمراجع التي اعتمد عليها في جمع المادة العلمية لموضوع البحث. تقسيم البحث: اقتضت طبيعة البحث أن أقسمه إلى مقدمة وتمهيد ومبحثين وخاتمة. أما المقدمة فتضمنت أهمية الموضوع، وسبب اختياره، والدراسات السابقة، ومنهج البحث وخطته، وأما التمهيد فتحدثت فيه عن تعريف مفردات عنوان البحث وهي الضمان - المشتقات – الحيوان – الدواء، أما المبحث الأول فعنوانه: المواد المشتقة من الحيوانات، واستخدامها في صناعة الأدوية، أما المبحث الثاني فعنوانه: الضمان وأثره على المشتقات الحيوانية الدوائية، وأما الخاتمة فتشتمل على أهم النتائج التي توصلت إليها في هذا البحث أهم النتائج البحث: يباح استخدام المشتقات الحيوانية في الغذاء والدواء إذا كان مصدرها حلالا ولا تباح المشتقات من حيوانات محرمة كالخنزير إلا عند الضرورة، يجب الضمان على كل من تسبب في خطأ في صناعة الدواء المصنع من المشتقات الحيوانية؛ لأنه تسبب في وفاة الإنسان وإزهاق روحه.

The study aims from this research to indicate animal derivatives, their uses, their legal judgment, and the guarantee statement in the manufacture of medicine manufactured from animal derivatives. Research approach: In writing this topic, I approached the scientific approach inductive, by tracking information on the subject matter of the research from its course, and also relied on the comparative approach to try to gather the opinions of scientists and jurists, making the opinions agreed in one saying that brings together the owners of the unity of opinion in one issue. I also attributed the verses to its wall, as well as graduated the hadiths according to the scientific method in graduation from the correct ones, if not in the correct ones showed the degree of talk, and judged it, as I concluded this research with a conclusion included the most important findings in this research, and finally: I removed the research with a detailed index of sources, and references on which he relied in collecting scientific material for the subject of research. Search split: The nature of the research required me to swear it into an introduction, a preface, two researchers and a conclusion. The introduction included the importance of the topic, the reason for its choice, previous studies, the research method and its plan, and the introduction talked about the definition of the vocabulary of the title of research, namely, guarantee - derivatives - animal – medicine, The first topic is entitled: Animal-derived substances, and their use in the pharmaceutical industry, while the second is entitled: Guarantee and its impact on animal pharmaceutical derivatives, and the conclusion includes the most important findings in this research. Top search results: It is permissible to use animal derivatives in food and medicine if their source is halal and derivatives from forbidden animals such as pigs are permitted only when necessary, all those who have caused a mistake in the manufacture of medicine manufactured from animal derivatives must be guaranteed because it caused the death of a human being and the loss of his soul.
