|a بهدف تشجيع الابتكار وخلق اقتصاد قائم على المعرفة، تدرس السلطة التشريعية القطرية إدخال آلية تحمي بمقتضاها نماذج المنفعة. ويمكن حماية الاختراعات بموجب قانون البراءات، ولكن يجب استيفاء متطلبات هذا القانون، أي الجدة، والخطوة الإبداعية والتطبيق الصناعي. ويمكن اعتبار الابتكار تحسينا واضحا على الفن الصناعي القائم، ولكن لا يمكن أن يكون موضوعا لطلب براءة حيث إنه يفتقر إلى شرط الخطوة الإبداعية. والهدف من هذه الورقة هو تزويد المشرع القطري بنظام لحماية نماذج المنفعة والذي يمكن تبنيه في الدولة.
|b With the aim to encourage innovation and create a knowledge-based economy, the Qatari legislative is considering introducing a mechanism in line with which utility models shall be protected. Inventions can be protected by patents law but the requirements of this law must be satisfied, namely novelty, inventive step (non-obviousness) and industrial applicability. An innovation can be regarded as an obvious improvement over the existing art but it cannot be a subject for a patent application since it lacks the requirement of an inventive step. The aim of this paper is to provide the Qatari legislative with a utility models system that can be adopted in Qatar.
