المستخلص: تناولت هذه الدراسة اتفاق التحكيم الذي ينعقد بواسطة الأجهزة التكنولوجية الحديثة، والذي يعتبر جوهر العملية التحكيمية، والخطوة الأولى في طرح النزاع على التحكيم، ومن خلاله يستمد المحكم سلطته في فصل النزاع، وقد استخدم الباحث المنهج الوصفي والتحليلي حيث تم وصف هذا الاتفاق من حيث مفهومة وصورة، وبيان شروطه الشكلية والموضوعية، وتحليل النصوص القانونية لبيان أساسه القانوني في قانون التحكيم الأردني. وقد توصلت هذه الدراسة إلى عدة نتائج أهمها أن اتفاق التحكيم يتم إبرامه عن طريق الأجهزة التكنولوجية الحديثة دون التواجد المادي لأطراف النزاع، ويوفر عدة مزايا أهمها سرعة في إبرام هذا الاتفاق، وقلة التكاليف ومواكبة التطور التكنلوجي، كما أن هنالك مشاكل تواجه هذا الاتفاق أهمها عدم مواكبة تطبيق القواعد القانونية الخاصة باتفاق التحكيم التقليدي على هذا الاتفاق. وخلصت إلى عدة توصيات لمواجهة العقبات التي تواجه هذا النوع من التحكيم، أهمها التوسع في مفهوم الكتابة والتوقيع ليشمل الوسائل التكنولوجية الحديثة، وذلك عن طريق تعديل التشريعات لتواكب التطورات المتسارعة في مجال الإنترنت.

This study has addressed the arbitration agreement, which is held by modern technological devices, which is the essence of the arbitral process and it is also the first step in raising the dispute to arbitration and gives the authority to the arbitrator to end the conflict. The researcher has used the descriptive and analytical approach where the agreement was described by its concept , conditions, formal and objective conditionally statements, and the analysis of the legal texts to demonstrate the legal basis in the Jordanian arbitration law of the Jordanian electronic transactions law. This study has reached to several results through this study, the most important result is that the arbitration agreement is concluded through the modern technological devices without the physical presence of the parties to the conflict. It also offers several advantages, such as the speed in the conclusion of this agreement, low cost and keeping pace with the technological development. There are also obstacles facing this agreement such as not keeping pace with the legal regulations of the traditional arbitration. The researcher reached several recommendations to address the obstacles facing this type of arbitration, and considered that the most important one is the expansion of the concept of writing and signature to include modern technological means, through the amendment of legislation to cope with the rapid developments in the field of internet.
