المستخلص: إن قاعدة "الحكم على الشيء فرع عن تصوره" لها أهمية كبيرة، عبر توجيهها للصناعة الفقهية نحو التصور للمسائل للحصول على الفتوى الأقرب لمراد الشرع. وبينت الدراسة معنى القاعدة وتأصيلها وأهميتها وضوابط إعمالها، وتطبيقات القاعدة في المعاملات المصرفية المعاصرة. وتوصلت الدراسة إلى نتائج من أهمها: أن القاعدة تعني: أنه لا يصدر حكم على أي مسألة قبل النظر الكافي فيها، وإدراكها إدراكا صحيحا سليما موافقا لحقيقتها مميزا إياها عن شبيهاتها، وما بعد المسألة من تبعات مبنية عليها، وما يؤثر في المسألة، وما يتأثر فيها، فلا تعطى الأشياء والأفعال أحكاما إلا بعد إحاطة علم ودراية كافيين فيها، كما وتوصلت إلى أن هذه القاعدة محل إجماع عند أهل العلم فلم يرد عليها استثناء، وأنه لا يستغنى عنها في الحكم على المستجدات الفقهية وخاصة في باب المعاملات المالية لتعدد صور المعاملة الواحدة واختلاف التكييف الفقهي للصورة عن الأخرى.

The rule of "Judging on a matter is an integral part of its general conceptual understanding" which has a great significance. The importance of this rule lies in its guidance to make jurisprudence about understanding the matter completely in order to come up with the closest Fatwa to the Islamic jurisprudence. It showed the clear meaning and understanding of the rule in addition to its principles, importance and application on the modern financial dealings. The main findings of this study show that the rule means that a judgment on any matter cannot be issued until having a thoughtful and thorough vision and a complete understanding as well that matches the matter precisely which is aligned with its nature and distinguishes it from other similar matters, through focusing on the cause and the result and other related subjects with the idea of effect and influence in mind. Therefore matters should not be given judgement until having a full understanding and knowledge. This study revealed that this rule has a unanimous consensus among experts and people of jurisprudence, and it does not include any exceptions, and also cannot be excluded when judging the jurisprudential concerns, especially in financial dealings when there are many versions of the same matter, thus yielding different jurisprudential views accordingly.
