المستخلص: هذا البحث تناول دراسة "المقاصد العامة وأثرها في فتاوى وقرارات هيئة كبار العلماء بالمملكة العربية السعودية "دراسة مقاصدية " ويهدف إلى: إبراز مكانة العلماء وبخاصة هيئة كبار العلماء بالمملكة العربية السعودية ودورهم في معالجة قضايا الأمة الإسلامية، ويشهد لهذا إقبال عامة المسلمين في شتى أقطار العالم على ما يصدر عنهم من فتاوى وقرارات حارت فيها عقول واختلطت فيها أقلام، والرد على المشككين والمنتقصين لهيئة كبار العلماء بالمملكة العربية السعودية، وبيان أن ما يصدر عنهم متفق مع مقاصد الشريعة العامة. منهج البحث: سار البحث وفق المنهج التأصيلي التطبيقي، وجمع المادة العلمية من مصادرها وترتيبها حسب الأهمية، وجعلته في: مقدمة، وتمهيد، ومبحثان، وخاتمة، وفهارس. وقد خلص في نهايته إلى: أن فتاوى وقرارات هيئة كبار العلماء تتناول النوازل والقضايا والمستجدات في حياة الأمة، وتصدر بالإجماع أو بالأغلبية، وهي تمثل الاجتهاد الجماعي في هذا العصر، وهذه الفتاوى والقرارات تصدر بناء على فهم وإدراك للواقع الذي تنزل عليها الأحكام الشرعية ولهذا عدوا الإحاطة بمعظم قواعد الشريعة من كمال الاجتهاد. للمقاصد الضرورية أمثلة وشواهد كثيرة في فتاوى وقرارات هيئة كبار العلماء بالمملكة العربية السعودية، كحفظ الدين والنفس والعقل والنسل والمال. أكدت هيئة كبار العلماء على أن الشريعة مبنية على جلب المصالح ودرء المفاسد، ومن تأمل كلامهم في الترجيح بين المصالح والمفاسد أو بين المصالح أنفسها أو المفاسد يتبين له ذلك، إن السمات البارزة في فتاوى وقرارات هيئة كبار العلماء في الأحكام الشرعية اليسر والسهولة، ورفع الحرج والتيسير في الأحكام لا يعني عندهم ترك التكليف والتهاون به، من المقاصد القطعية العامة مقصد: الاجتماع والائتلاف، وجاء تقرير هذا المقصد في فتاوى وقرارات هيئة كبار العلماء في أكثر من موطن وبأكثر من أسلوب، اقتفت هيئة كبار العلماء في فتاويها وقراراتها أثر الشريعة في رعايتها لمقصد العدل في كلياتها وجزئياتها في جميع الأحكام الفقهية من عبادات ومعاملات.

This research deals with the study of “General Purposes and their Impact on the Fatwas and Decisions of the Council of Senior Scholars in the Kingdom of Saudi Arabia“ A Study of Objectives ”and aims to: Highlight the status of scholars, especially the Council of Senior Scholars in the Kingdom of Saudi Arabia, and their role in addressing the issues of the Islamic Ummah. On the fatwas and decisions issued by them in which minds are confused and mixed with pens, respond to the skeptics and detractors of the Council of Senior Scholars in the Kingdom of Saudi Arabia, and a statement that what comes from them is consistent with the general objectives of Sharia. Research methodology: The research proceeded according to the applied methodology, collecting the scientific material from its sources and arranging them according to importance, and made it in: an introduction, an introduction, two studies, a conclusion, and indexes. In his conclusion, he concluded: The fatwas and decisions of the Council of Senior Scholars address the calamities, issues and developments in the life of the ummah, and they are issued unanimously or by the majority, and they represent collective diligence in this era, and these fatwas and decisions are issued based on an understanding and awareness of the reality to which the legal rulings come down. Most of the rules of Sharia are of perfection of diligence. The necessary objectives have many examples and evidence in the fatwas and decisions of the Council of Senior Scholars in the Kingdom of Saudi Arabia, such as preserving religion, soul, reason, offspring, and money. The Council of Senior Scholars affirmed that Sharia is based on bringing interests and warding off evil, and those who contemplate their arguments in favoring interests and evils or between interests themselves or evils this will become evident to him. In rulings, it does not mean for them to leave the commission and be negligent with it, one of the general definite purposes is the goal: meeting and coalition, and the report of this purpose came in the fatwas and decisions of the Council of Senior Scholars in more than one place and in more than one method. In its faculties and its parts in all jurisprudential rulings of acts of worship and transactions.
