| 520 | |a نظريا من الإجحاف ألا نقر أن التعديل الدستوري الأخير سواء في مجمله أو في جزئياته قد أبرز إرادة الجزائر ضمن أسمى تشريع فيها، بمجموعة من الأسس لم تكن موجودة من قبل، أولها التأسيس لاقتصاد حر عماده الإنتاج والتنافسية ليس فقط لأجل التنمية المحلية، بل والارتقاء بها نحو أهداف التنمية المستدامة، وقد جاء التنظير لها بعدة نصوص إلا أن ذلك لا يعد كافيا إن لم تدعم المضامين بالضمانات، بتعطيل المعوقات وتفعيل تلك الأسس بإعمال جميع الآليات، ومن خضم التوصيات، نقترح ضرورة التعديل في بعض القوانين لضمان فاعلية النصوص الدستورية، انعكاسا على كافة التشريعات. |b Theoretically speaking, it would be unfair to deny that the last constitutional reform had, partially or totally, reflected the determination of Algeria through its highest legislation after introducing a set of new constituents, such as the establishment of a free economy based on competitiveness, not only for local development, but towards the achievement of sustainable development objectives. This is systematically theorized through several texts, they are still not enough without providing guarantees. We suggest the amendment of some legal texts to ensure the effectiveness of constitutional texts which is mirrored in all legislative processes. |d Théoriquement, il serait injuste de ne pas reconnaître que le dernier amendement constitutionnel a souligné la volonté de l'Algérie, à un ensemble de fondements qui n'existaient pas auparavant, dont le premier est la mise en place d'une économie libre non seulement dans un souci de développement local, mais aussi son avancement vers un développement durable. Cela ne suffit pas si les contenus ne sont pas soutenus par des garanties, et en activant ces fondements en mettant en œuvre tous les mécanismes, nous suggérons donc la nécessité de modifier certaines lois pour assurer l'efficacité des textes constitutionnels, comme une réflexion de toute législation. | ||
