|a تناول البحث مسائل الأمر عند المالكية من حيث الدراسة الأصولية الفقهية. وكانت مشكلة البحث تدور حول إشكالية الدراسة الأصولية النظرية المجردة عن ثمرتها الفقهية، أو الدراسة الفقهية المجردة عن أصولها وأدلتها، لأن الهدف من دراسة علم الأصول هو الوصول إلى نتيجته الفقهية العملية. لذلك جاء البحث ببيان دلالات الأمر من خلال آراء المالكيين الأصوليين، ثم بإبراز أمثلة فقهية مالكية تتفرع عن تلك الدلالات. أما بالنسبة لمنهج البحث فقد اعتمد فيه على المنهج الاستقرائي التحليلي. وكان من أهم النتائج؛ أن الأمر المطلق يدل على الوجوب عند جمهور الأصوليين المالكيين وهو المعتمد، وقد يدل على الندب لقرينة صارفه. وانه يقتضي الفور عند بعضهم، وقد يحمل على التراخي عند بعضهم أيضا. وقد أوصى الباحث بالاهتمام بدراسة مسائل الأمر لأهميتها في الوصول إلى معرفة الأحكام الشرعية العينية.
|b The research dealt with the issues of commands according to the Malikis, as the study was based on a jurisprudential and principles basis of Fiqh perspective. The research problem revolved specifically around the matter of a theoretical fundamentalist study stripped from its jurisprudential desired fruit. In addition, the research involved an abstract jurisprudential study of principles and evidence alone, outside of the resulting particular fiqh rulings that arise from its applications. This is because the aim of studying the principles of jurisprudence was to reach its practical jurisprudential conclusion. And therefore, the research came to clarify the implications of the command through the views of the Maliki Usool-ul-fiqh scholars and then to highlight the examples of Maliki jurisprudence branching from those connotations. As for the research methods utilised, it was based on an inductive-analytical method. One of the most important results obtained was that the majority of Maliki scholars considered the absolute command indicates the necessity, and it may indicate it as recommended if there is another evidence that proves otherwise. In addition, the results indicate a principle of immediacy exists and as a result it is believed according to some Malikis, that this has the potential to lead to the corollary effect and cause laxity. The researcher recommended paying close attention to studying the topics of command because of their importance in reaching knowledge of the legal obligations that must be performed by each individual Muslim.
