المستخلص: فإن العالم بأسره قد شهد ثورة تقنية في كافة مناحي الحياة، وكان من أهم منتجات هذا التقدم التقني ظهور ما يسمى بالنقود الرقمية، لذا آثرت أن أكتب بحثا حول هذه النازلة الفقهية، ووسمته بـــ "النقود الرقمية وأثر التعامل بها على الحياة الاقتصادية -دراسة فقهية اقتصادية مقارنة"، للوصول إلى حكم فقهي ملائم لها. وقمت بتقسيم هذا البحث إلى مقدمة، ومبحث تمهيدي. وثلاثة مباحث، وخاتمة، وهي على النحو التالي: أما المقدمة: ذكرت فيها أهمية موضوع البحث، وإشكالياته، وأهم الدراسات السابقة والمنهج المتبع في كتابته، وخطة البحث. وأما المبحث التمهيدي: تكلمت عن حقيقة النقود الرقمية، وأنواعها، ونشأتها، وتطورها، وخصائصها وإيجابياتها، وسلبياتها. وأما المبحث الأول: تكلمت عن الطبيعة القانونية للنقود الرقمية، والموقف الدولي من التعامل بها، ومدى قبولها، وتكييفها الفقهي، ومدى تحقق وظائف النقود وضوابط اعتبارها في هذه النوعية من النقود. وأما المبحث الثاني: ذكرت الحكم الفقهي للتعامل بالنقود الرقمية، مع ذكر آراء العلماء، وأدلتهم ومناقشتها، والرأي الراجح في هذه المسألة. وأما المبحث الثالث: تكلمت عن أهم الآثار الاقتصادية للتعامل بالنقود الرقمية وتداولها على الأفراد والمجتمعات. وأما الخاتمة: فإنني ذكرت فيها أهم النتائج والتوصيات التي توصلت إليها، وقد انتهى الباحث إلى عدة نتائج، أهمها: عدم جواز التعامل بالنقود الرقمية وتداولها على ماهي عليه الآن، لما يترتب على التعامل بها من مفاسد وأضرار لا حصر لها. ويوصي الباحث المجامع الفقهية ودور الإفتاء العالمية ورجال السياسة والاقتصاد ببحث هذه النازلة بتوسع، مع إيجاد البدائل لها.

The entire world has witnessed a technological revolution in all aspects of life, and one of the most important products of this technical progress was the emergence of the so-called digital money; Therefore, I chose to write a research paper on this jurisprudential calamity, and called it "digital money and the impact of dealing with it on economic life - a comparative economic jurisprudence study"; To reach an appropriate doctrinal ruling. I divided this research into an introduction, an introductory chapter, three chapters, and a conclusion, which are as follows: As for the introduction: In it, I mentioned the importance of the research topic, its problems, the most important previous studies, the method used in writing it, and a plan. As for the introductory topic: I talked about the reality of digital money, its types, its origins, its development, its characteristics, its advantages and its disadvantages. As for the first topic: I talked about the legal nature of digital money, the international position on dealing with it, the extent of its acceptance, its doctrinal adaptation, and the extent to which the functions of money are achieved and the controls for considering it in this type of money. As for the second topic: I mentioned the jurisprudential ruling for dealing with digital money, with mentioning the opinions of scholars, their evidence, discussing them, and the most correct opinion on this issue. As for the third topic: I talked about the most important economic effects of dealing with digital money and its circulation on individuals and societies. As for the conclusion: I mentioned in it the most important results and recommendations that I reached, and the researcher reached several conclusions, the most important of which are: the inadmissibility of dealing with digital money and its circulation as it is now; Because of the consequences of dealing with it from the harms and the innumerable. The researcher recommends jurisprudence academies, international fatwa houses, politicians and economists to study this calamity extensively, while finding alternatives to it.
