المستخلص: يعالج هذا البحث تقويم مسلك تخريج الفروع على الفروع بمجال الفتوى المعاصرة، من خلال رصد نماذج من أخطاء المفتين وتصحيحها في ضوء ضوابط هذا المسلك الاجتهادي. وقد توسل فيه الباحثان بالمنهجين: الاستقرائي والتحليلي؛ لمناسبتهما لطبيعة المعالجة النقدية في البحث. ومن النتائج التي انتهى إليها أن كثيرا من المخرجين تنكبوا الضوابط المرعية في المخرج والمخرج عليه، كالاطلاع على المعتمد المعمول به في المذاهب، والإلمام بالحديث ومقاصد الشريعة، ونخل الفروع وإطراح الشاذ منها، وأن التخريج أمسى مركبا لبعض المتلاعبين بالفتوى، لتمرير رخصهم وشذوذاتهم، وأن للخطأ في تخريج الفروع على الفروع أسبابا، ومن ذلك: التخريج على فرع مذهبي تجاوزه الزمن بمستجداته العلمية؛ إذ يركن إليه المفتي جمودا على مسطور المذهب، وذهولا عما استجد في ساحة الطب أو الاقتصاد أو الاجتماع، والأصل استصحاب ما يكتنف الفروع من جديد يقضي بإعادة النظر في تصورها وتكييفها، وانخرام المشابهة بين النازلة والفرع المخرج عليه، وهي ملاك التخريج، فبتحققها يتقوم إلحاق فرع بفرع، وبانتفائها يمتنع الإلحاق، على نحو ما تبدى في تعريف (تخريج الفروع على الفروع)، وانضباط ماهيته بتحقق المشابهة أو الاتفاق في العلة.

This research deals with the evaluation of the course of editing branches over branches in the field of contemporary Fatwa, by monitoring examples of Mftis errors and correcting them in the light of this diligent course terms. The two researchers used the two approaches: indctive and analytical; de to their relevance to the nature of critical treatment in the research. Among the results reached is that many editors neglected the terms observed in the editing and the part been edited on it, such as reading about the approved in practice in doctrines, and being knowledgeable of Hadith and the purposes of Sharia, filtering the branches and eliminating the ibnormal ones, and that editing became a vehicle for some manipulators of fatwas, in order to pass their void permissions and ibnormalities. And that the error in graduating branches over branches has causes, including: graduation on a sectarian branch that has outlived time with its scientific developments; As the Mufti rests on him stagnation on the doctrine of the doctrine, and amazed at what has been new in the field of medicine, economics or sociology, and the original accompanying what surrounds the branches again requires a reconsideration of their conception and adaptation, and the denial of the similarity between the calamity and the branch exiting to it, and it is the angel of graduation. Branch by branch, and by its negation, attachment is prohibited, as is shown in the definition (graduating branches over branches), and the discipline of its essence by achieving similarity or agreement in the cause.
