|a يتعلق البحث بموضوع مهم من موضوعات دلالات الألفاظ، وهو موضوع مفهوم الغاية وتطبيقاته في فقه البيوع. وجاء البحث في تمهيد ومبحثين وخاتمة. فالتمهيد ذكرت فيه تعريف مفهوم المخالفة وأقسامه وشروطه، والمبحث الأول في الجانب التأصيلي لمفهوم الغاية من خلال تعريفه وتعريف الغاية وتحديد مجال البحث، وأقوال الأصوليين في حجية مفهوم الغاية مع الأدلة والمناقشة والترجيح، والمبحث الثاني في الجانب التطبيقي لمفهوم الغاية في فقه البيوع، وجاءت التطبيقات في المسائل الآتية: حكم بيع الثمار قبل بدو صلاحها، وحكم بيع ما في بطون الأنعام حتى تضع، وحكم بيع المغانم قبل قسمتها، وحكم بيع الصدقات قبل قبضها، وحكم بيع الطعام قبل قبضه. والخاتمة فيها أبرز نتائج البحث.
|b This research is concerned with an important subject of (Dalālāt al-alfāẓ) semantic, which is the concept of (al- Ghāyah) post limitation matters and its applications in Fiqh of Sales.This research is composed of an introduction, two sections, and concluding remark. The introduction covers the definition of (al-Ghāyah) post limitation matters, its types, and conditions. The first section provides a doctrinal perspective of this concept and draw the scope of this research as well as gathering and weighing the scholarly opinions of (al-Uṣūlīyīn) jurists on the legitimacy this concept. Whereas the second section examines the practical applications of this concept which covers some of the texts of (al-Sunnah al-Nabawīyah) the actions and deeds of prophet Mohammed peace be upon him. These applications include: The legality of selling the unripe fruits. The legality of selling unborn livestock. The legality of selling surpluses or profit before they are distributed. The legality of selling donated assets or money before they are handed to the doner. The legality of selling of food before its being grasped in hand. The conclusion remark provides some of the important findings of the research.
