المستخلص: تعاني الاستغلالات الوقفية الفلاحية القائمة قانونا على عقود الحكر والمزارعة والمساقاة من حالة ركود، سببت شللا ملحوظا لمؤسسة الوقف في الجزائر، حال دون تحقيق اقتصاديات هذا الأخير من خلال التنمية والريع الوقفي المعتبر، وهو ما يستوجب تفعيلا لها من خلال الاستفادة من أحكام عقد الإجارة المنتهية بالتمليك وترجمة ذلك في شكل عقد اعتماد إيجاري لأصول منقولة تتعلق بالنشاط الفلاحي، وهو ما يتطلب توفير البيئة التشريعية والمصرفية المناسبة، والتي تتخذ من أحكام الشريعة الإسلامية ومن مقتضيات الوقف ومصلحته الفضلى أساسا لها.

The agricultural wakfs exploitations which legally based on emphyteutic lease and lease to compliant and partial cloning contract suffering from a recession, that's what caused the damage for the waqf foundation, hindered the realization of the savings of these last by the development and the good income of wakf, which requires an activation taking advantage of the provisions of the leasing end by ownership, this translates into a credit-lease contract related to an agricultural activity, which requires the provision of the appropriate legislative and banking environment, which are based on the provisions of the Islamic shariah and the requirements and the best interests of the waqf.

Les exploitations agricoles des wakf qui est légalement basées sur bail emphytéotique et bail à complant et contrat de colonage partiaire souffrant d'une récession, c'est ce qui a causé les dégâts pour la fondation de wakf, entravé la réalisation des économies de ces dernières par le développement et le bon revenu de wakf, qui nécessite une activation en profitant des dispositions de bail se termine par la propriété, cela se traduit par un contrat de crédit-bail lié à une activité agricole, ce qui nécessite la mise en place d'un environnement approprié législatif et bancaire, qui sont basés sur les dispositions de la charia islamiqueet les exigences et le meilleur intérêt du waqf.
