|a لقد جاءت الشريعة الإسلامية في أصولها وفروعها بمقاصد تشريعية عظيمة، تنظم الحياة الإنسانية في جميع مجالاتها، فلكل حكم شرعي غاية ومصلحة قد شرع الحكم من أجلها، ومن القواعد الشرعية المتعلقة بالمقاصد قاعدة "ما حرم سدا للذريعة أبيح للمصلحة الراجحة"، والمقصود منها أن ما كان مباحا من الأفعال في أصله إلا أنه يفضي إلى مفسدة فإن الشريعة تحرمه سدا لهذه المفسدة المستجلبة، أما إذا ترجحت مصلحة في الفعل على ما تقتضيه تللك المفسدة فإن الشارع يبيح ذلك الفعل ويأذن فيه جلبا للمصلحة الراجحة، وقد جمعت في هذه البحث مجموعة من الأحكام المتعلقة بأحكام المرأة، مما كان تحريمها سدا للذريعة وأبيحت للحاجة.
|b This article aims to shed light on the effect of opening pretexts on the calamities of woman provisions. The Islamic Sharia has come with great legislative purposes that organize human life in all its aspects. Every legal provision has a purpose for which it has been legislated. One of the provisions related to the purposes is “What is forbidden to block the pretext is permissible for the interest.” This means that whatever act is permissible in the origin, but leads to corruption, Sharia prohibits it in order to block the evil that is brought about. However, if the interest is preferred, then Sharia permits it in order to bring about the most important interest. In this study, I have collected a set of woman provisions, which was forbidden to keep the evil away and permitted for necessity.
