|a هدفت هذه الدراسة إلى إبراز "حقوق الطفل" التي كفلته له الشريعة الإسلامية من خلال تقديم تصور مقترح لإعادة صياغة اتفاقية حقوق الطفل في ضوء (المنظر) التربوي الإسلامي، من خلال معرفة واقع تطبيق العالم العربي لاتفاقية حقوق الطفل، ومن خلال معرفة واقع التطبيق العالمي لاتفاقية حقوق الطفل، كما هدفت الدراسة إلى معرفة تجربة الاتحاد الأوربي لحقوق الطفل... وكذلك معرفة تجربة المملكة العربية السعودية في وثيقة حقوق الطفل السعودي في الأنظمة الوطنية، كما هدفت إلى معرفة مدى ملاءمة الاتفاقية للبعد التعليمي، ومعرفة مدى ملاءمة الاتفاقية المقترحة للبعد الاجتماعي، وتوصلت الدراسة إلى العديد من النتائج منها: أن لأغلب الدول العربية تحفظات على اتفاقية حقوق الطفل فيما يخالف الشريعة الإسلامية، أو دساتير وأنظمة البلدان، كما أن لبعض دول العالم كذلك تحفظات على ما لا يتلاءم مع دساتيرها وقوانينها، وجاء من أبرز النتائج ضرورة إعادة صياغة بعض بنود اتفاقية حقوق الطفل في ضوء المنظر التربوي الإسلامي.
|b This study aims at highlighting the "rights of the child" provided under Islamic Sharia through presenting a proposed conception to re-draft the Agreement of Child Rights in light of Islamic educational perspective, by understanding the reality of the Arab world's application of the Agreement of Child Rights and by understanding the reality of the international application of the Agreement of Child Rights. The study also aimed to learn about the European Union's experience with child rights, as well as the Kingdom of Saudi Arabia's experience with the Saudi Child Rights Document pursuant to National Regulations. It also aimed to determine the extent to which the Convention is appropriate to the educational dimension, as well as the suitability of the proposed agreement to the social dimension, and the study yielded numerous findings, including the fact that most Arab countries have reservations to the Agreement of Child Rights in violation of Islamic Sharia, or State constitutions and regulations, and some countries around the world have reservations about what is not compatible to its constitutions and laws. Re-drafting some articles of the Agreement of Child Rights in light of the Islamic educational perspective is one of the most notable outcomes.
