|b Based on the freedom of competition guaranteed by the Kuwaiti constitution, freedom of economic activity is guaranteed to all, in a manner that does not lead to restricting, preventing or harming free competition without replacing it with what is required by international treaties and agreements in force in the State of Kuwait, hence the creation of Law No. (10) for the year 2007 amended by Law No. (2) for the year 2012 in the matter of protection of competition and its executive regulations in order to control market mechanisms and raise the efficiency of their performance to ensure the existence of fair and fair competitiveness in the market, achieving protection for consumers by providing a cheap good or service with high quality and achieving protection for producers in accordance with For competition, the Competition Protection Agency has the authority to deal with any imbalances related to competition in the market, whether they are a result of harmful practices in competition or as a result of regulations harmful to competition, in addition to reviewing the processes that take place between companies in a way that does not affect free competition in the market, and the problem of the study is determined in a major question: What is the role of the Competition Protection Agency in confronting monopolistic practices by companies in Kuwaiti society, and activating the powers of the Competition Protection Authority? The working method of fish auction markets in order to understand whether there is a possibility to enhance competition, and the research aims to highlight the importance of the mechanism of action and activation of the competition protection apparatus in Kuwaiti society, and to improve the performance of fish markets, with the aim of reaching the regulatory framework for these markets, and re-designing these auctions in light of international best practices. In light of the above, the study recommends the following: 1- The flow of information, along with identification and registration, should make the auction pricing process more competitive by helping buyers and sellers better understand the product's reputation. 2- There must be an advanced cooperation mechanism between the various government agencies involved in supervising auctions in Kuwait in order to manage transactions in a more effective and competitive manner. 3- The competition protection agency must play a proactive role in determining and imposing punishment for any behavior prohibited under Law No. (10) of 2007 regarding the protection of competition.
