المستخلص: Since global widespread outbreak of the Covid-19 virus in March 2020, governments supported companies and business projects in various ways to recover from the pandemic effects without being bankrupted and shut down. Some of these ways were: financing debt and losses, supporting employment, reducing business costs, and exempting fees and taxes. In addition to these governmental successful efforts, it was necessary to have legislative frameworks that assist the affected companies and business projects from bankruptcy. Especially since the applied bankruptcy provisions before the pandemic grant creditors the right to file bankruptcy if they couldn’t pay their debts in all cases through certain conditions. Otherwise, they would be subjected to a penalty that stops them from practicing business projects for a certain period of time. Setting up an effective framework to the current bankruptcy provisions, would grant companies and business projects sufficient flexibility to get rid of bankruptcy effects. It is also a better way to advanced economy and development as well as frame the financial crisis at lowest levels. The new legislation in different types (law, decree, or decision) must include several legal means concerned with the pandemic effects on creditors and competent courts. It should encourage out-of-court debt settlement with simplified procedures too. This research focuses on the legislative framework adopted by the federal legislator to save companies and business projects from bankruptcy in the face of the covid-19. That is in comparison with what some legislators’ laws in order to determine the effectiveness of the national legislative framework to achieve its desired goals, and to find out its strengths and weaknesses for future amendments.
