المستخلص: يهدف هذا البحث إلى بيان مفهوم الاحتكار، وأنواعه، والمخاطر المترتبة عليه من غلاء في الأسعار، كما يهدف إلى بيان سماحة الدين الإسلامي، وتميزه عن جميع الشرائع والقوانين التي عجزت أن تجد حلا يقطع أصل الاحتكار ويأمن الناس بسببه على أسواقهم، كما يهدف إلى بيان بعض صوره المعاصرة، مثل احتكار أسواق الناس، واحتكار الأدوية في زمن كورونا، واحتكار حق الابتكار، واحتكار حقوق الطبع، وقد اعتمدت على المنهج الاستقرائي عند سبر الأحاديث الواردة في الموضوع، والمنهج المقارن عند ذكر أقوال الفقهاء، والمنهج الاستنباطي عند ذكر المسائل المعاصرة، ومن أهم النتائج التي تم التوصل إليها: إن الاحتكار يدور لفظه على الحبس والامتناع، وإن الله ورسوله حرما الاحتكار الذي يضر بالغير ويؤذيه، وأن الشريعة الإسلامية تنظم حياة الناس الاقتصادية وتسهم في حل مشكلاتهم، وأن الملكية الفكرية -أي حق المؤلف –أصبح معترفا ومصانا في القوانين والأعراف، وأصبح التعدي عليه بغير حق عدوانا وظلما يكون المسلم أحرص على صون ورعاية هذا الحق حيث أنه مأمور بالوفاء بالذمم والعهود، ويوصي الباحث بأهمية تقنين أحكام الشريعة الإسلامية في مجالات الحياة المختلفة؛ لما لهذا من الأثر في "نهضة الأمة وتقدمها" و "استتباب الأمن وشيوع الأمان"، ومن ذلك تقنين أحكام الاحتكار.

This research aims at explaining the concept of monopoly, its types, and the dangers involved such as high prices. In addition, the research is keen to highlight the tolerance of Islam which has made Islam more distinct than all religions and laws which have remained unable to find a solution eradicate monopoly and make people feel secure about their markets. Another objective of this research is to display some modern forms of monopoly such as monopolizing people’s markets, medicines in the time of corona, intellectual property rights and copy rights. The research has applied the inductive approach when probing into the Hadiths handling this topic and the comparative approach during the discussion of the sayings of scholars. The research also applied the deductive approach when examining the contemporary issues. By the end of the research, the researcher has referred to the most important findings. One of those findings is that monopoly revolves around imprisonment and abstention and that Allah and His Messenger prohibited monopoly as it causes harm to others. Moreover, the Islamic Sharia organizes people’s economic life, contributes to solving their problems and that intellectual property – copyright- has become recognized and protected by laws and customs. Any violation of those rights has been classified as aggression or injustice. Hence, the Muslim is keen on preserving and caring for those rights, as he is commanded to fulfill those obligations and covenants. To conclude, the researcher recommends codifying the provisions of the Islamic Sharia in various fields of life for their impact upon “the renaissance and progress of the nation” as well as “restoring and spreading security” and codifying the provisions of monopoly is an example.
