المستخلص: تهدف الدراسة إلى تبيان طبيعة مؤسسة الرئاسة كأحد فروع السلطة التنفيذية في النظام السياسي الإسلامي وفي النظام السياسي الفلسطيني. وتدور إشكالية الدراسة حول سؤال رئيس، مفاده: ما هي طبيعة مؤسسة الرئاسة في النظامين الإسلامي والفلسطيني. وأتبع الباحث المنهج الوصفي المقارن؛ ولذلك لوصف مؤسسة الرئاسة في النظام السياسي الفلسطيني ومقارنتها مع مؤسسة الرئاسة في النظام السياسي الإسلامي. وتوصل الباحث لعدة نتائج كان أبرزها أنه يعتبر حق النصح من الحقوق البارزة في النظام السياسي الإسلامي في دولة الخلافة والذي يميزه عن غيره من الأنظمة الوضعية التي تفتقر لمثل هذه الحقوق. ومن أبرز توصيات الدراسة أنه يتعين على أصحاب القرار في وقتنا الحالي السير كما سار عليه الخلفاء الراشدين خاصة في حق النصح، وتفعيل الشورى، فكلاهما يؤدي للعديد من النتائج الإيجابية المتمثلة في تحقيق أفضل السياسات لصالح الجماعة من غير إفراط ولا تفريط.

The study aims to show the nature of the presidency as one of the branches of the executive authority in the Islamic political system and in the Palestinian political system. The problem of the study revolves around a main question: What is the nature of the institution of the presidency in the Islamic and Palestinian systems. The researcher followed the descriptive comparative approach; Therefore, to describe the institution of the presidency in the Palestinian political system and compare it with the institution of the presidency in the Islamic political system. The researcher reached several results, the most prominent of which was that he considers the right to advice one of the prominent rights in the Islamic political system in the Caliphate state, which distinguishes it from other man-made systems that lack such rights. Among the most prominent recommendations of the study is that the decision-makers at the present time should follow the path of the Rightly Guided Caliphs, especially with regard to the right to advice, and to activate the Shura, both of which lead to many positive results represented in achieving the best policies for the benefit of the community without exaggeration or negligence.
