لازال العالم يعاني من أثار تفشي فيروس كورونا Covid 19 الذي أربك المشهد العالمي بعد انتشاره بشكل كبير في جميع دول العالم نتيجة تفشيه في جمهورية الصين الشعبية وهي الدولة الأكثر سكانا على مستوى العالم وبدأ هذا الأمر من مدينة وهان الصينية مما أودى بحياة الآلاف. ومع تزايد مخاوف الانتشار المستمر ومعدلات الإصابة والوفيات المتزايدة عالميا، فقد فرضت أغلب الدول إجراءات تحفظية واحترازية، وصلت إلى إعلان حالة الطوارئ بل وفرضت عزلا وإقفالا شاملا للبلاد سعيا منها للتخفيف من حدة الانتشار غير المسبوق للفيروس. وبسبب انتشار تلك الجائحة فقد انتكس العالم اقتصاديا وهو ما أثار تساؤلا حول أثر هذه الجائحة على الالتزامات في العقود والاتفاقيات، خاصة في مجال عقود العمل وهو ما سوف نتطرق له في هذا البحث من حيث إسباغ الصفة القانونية لهذا الجائحة على الالتزامات العقدية، كحادث أو ظرف طارئ أو قوة قاهرة وبالتالي سيؤثر هذا الوصف في أداء الالتزامات العقدية، من حيث التأخير أو التقليص وأيضا الاستحالة في تنفيذ الالتزامات العقدية، ولهذا الوصف دور في الحد من النتائج المترتبة على تنفيذ الالتزام العقدي وما قد يؤدي إلى انقضاء الالتزام ذاته نتيجة الحوادث التي لا يمكن دفعها أو توقعها بل وتخرج عن سيطرة أطراف الالتزام.
The whole world is still suffering from the effects of the outbreak of the Covid 19 virus, which confused the world scene after its widespread in all countries of the world as a result of its outbreak in the People's Republic of China, which is the most populated country in the world. This issue started in the Chinese city of Wuhan and resulted in killing thousands. With the increasing fears of continuous proliferation and increasing rates of injury and death globally, most countries imposed precautionary measures; to the extent of declaring a state of emergency and even imposed comprehensive isolation and closure of the country in an effort to reduce the severity of the unprecedented spread. Because of the spread of this pandemic, the world has relapsed economically and this raised a question about the impact of this pandemic on the obligations in contracts and agreements, especially in the field of work contracts, which we will address in this research, concerning giving the legal form of this pandemic on contractual obligations, such as an accident, emergency state or force majeure, and therefore this description will affect the performance of contractual obligations, and this description has a role in limiting the consequences of implementing the contractual obligation and what may lead to the expiry of the obligation itself as a result of accidents that cannot be avoided or expected, or even out of control of the parties in the obligation.
