المستخلص: تناولت الدراسة العدالة الانتقالية في ظل سيادة القانون، بالتطبيق على الفترة الانتقالية لمرحلة ما بعد حكومة الإنقاذ الوطني في السودان. نبعت مشكلة الموضوع في أنه بغياب تطبيق مبدأ العدالة وسيادة القانون واجهت أغلب الدول انتفاضة شعبية في ظل سوء السياسات التي كانت تنتهجها وتطبقها الحكومات الدكتاتورية المستبدة فقد فشلت هذه الحكومات في تحقيق العدالة وتطبيق مبدأ سيادة القانون وأدت إلى ظهور الفساد والمحسوبية والظلم. وكمنت أهمية الموضوع في تسليط الضوء بأن العدالة الانتقالية تواجه عدة تحديات في معالجة الصراعات الهيكلية، منها ميل مجال العدالة الانتقالية إلى التركيز على المظالم الاجتماعية والاقتصادية، الفقر والجوع والفساد ونهب الموارد الطبيعية وغير ذلك. هدفت الدراسة إلى تبيان الحقيقة وراء تحقيق العدالة الانتقالية، ومحاسبة المسؤولين الفاسدين والقصاص العادل منهم، ثم التطهير والإصلاح المؤسسي وتحقيق المصالحة الوطنية. اعتمدت الدراسة على المنهج التاريخي، والمنهج الوصفي التحليلي. خرجت الدراسة بعدد من النتائج أهمها: أن العدالة الانتقالية في السودان تتطلب نجاح نظام الحكومة الانتقالية وهذا ما لم يتحقق حتى الآن، وأن مشكلة السودان مشكلة عميقة ومتجذرة ويشترك فيها أغلب أفراد الشعب ولا يصلح معها سياسة العقاب، وأن سوء السياسات الداخلية والخارجية للسودان هي التي أدت إلى تدهور أوضاع البلاد. وأوصت الدراسة بتوصيات مختلفة، منها: يتطلب نجاح حكومة الفترة الانتقالية أن تكون سلطة الفترة الانتقالية في يد الشعب وأن تكون حكومة مدنية، ويجب أن يتم حكم الفترة الانتقالية من خلال الأنظمة والقوانين التي تعتمد على المحاسبة. وأن تعي حكومة الفترة الانتقالية أن مهمتها تسيير أمور البلاد للخروج بها من المأزق الذي وقعت فيه. وأن تحقيق العدالة الانتقالية في ظل سيادة القانون تعتمد على الممارسة المشروعة وليس التمثيل المشروع. كما أن تحقيق العدالة الانتقالية يتطلب وجود مجلس سيادي وقيادي ومجلس استشاري ومجلس محاسبة.

The study dealt with transitional justice under the rule of law, by applying to the transitional period of the post-Government of National Salvation in Sudan. The problem of the issue stemmed from the fact that in the absence of the application of the principle of justice and the rule of law, most countries faced a popular uprising in light of the bad policies that were pursued and applied by tyrannical, dictatorial governments. The importance of the topic was to highlight that transitional justice faces several challenges in addressing structural conflicts, including the tendency of the field of transitional justice to focus on social and economic grievances, poverty, hunger, corruption, plundering of natural resources, and more. The study aimed to clarify the truth behind achieving transitional justice, holding corrupt officials accountable and just retribution from them, then purification, institutional reform and achieving national reconciliation. The study relied on the historical method, and the descriptive analytical method. The study came out with a number of results, the most important of which are: that transitional justice in Sudan requires the success of the transitional government system, and this has not been achieved so far, and that the problem of Sudan is a deep and rooted problem in which most of the people participate, and the policy of punishment does not fit with it, and that the bad internal and external policies of Sudan are what led to the deterioration of the situation in the country. The study recommended various recommendations, including: The success of the transitional government requires that the authority of the transitional period be in the hands of the people and that it be a civilian government, and that the transitional period must be governed by systems and laws that rely on accountability. And that the transitional government be aware that its mission is to manage the country's affairs to get it out of the predicament it has fallen into. And that achieving transitional justice under the rule of law depends on legitimate practice and not legitimate representation. In addition, achieving transitional justice requires the presence of a sovereign and leadership council, an advisory council, and an accountability council.
